Delhi, Nov 21: Delhi High Court on Tuesday directed
petitioner to approach the Ministry concerned against National Conference
leader Farooq Abdullah over his alleged remarks on Pakistan-occupied Kashmir
and refused to pass any order on the Public Interest Litigation.
A bench of Delhi High Court Acting Chief Justice Gita Mittal and Justice C Hari
Shankar issued the ruling.
Maulana Ansar Raza of Delhi had filed a PIL before Delhi High Court that alleged that Member of Parliament from Srinagar Farooq Abdullah had favoured Pakistan and insulted India so "immediate investigation" and "arrest" be taken against him.
It was alleged that on November 11 Abdullah said that PoK belonged to Pakistan and "this would not change" no matter how many wars India and Pakistan fought.
Petitioner further submitted that Abdullah had made "such controversial remarks and statements by which the nation and its citizens feel ashamed of such persons being Indian citizens".
Raza contended that penal offences including sedition and treason under the Indian Penal Code be reigstered against Farooq Abdullah.
The bench held that the petition had been filed without making any representation before the authorities concerned and directed the petitioner to approach the Ministry concerned which will decide the issue on merits. UNI
