New Delhi, Mar 19: The Supreme Court on Monday negated a Public Interest Litigation seeking
disqualification of Bihar Chief Minister, Nitish Kumar for alleged concealment
of a criminal case against him in his election affidavit.
Election Commission had, in December last year, stated that
at the time, when he had filed the affidavit, there was no case pending against
Mr Kumar.
Lawyer Manohar Lal Sharma's PIL had alleged that Nitish Kumar had illegally concealed in his election affidavit that a criminal case was pending against him.
A bench, of Chief Justice of India Dipak Misra and Justices A M Khanwilkar and D Y Chandrachud, held, 'The petition is devoid of merits and substance. We are dismissing it.'
Mr Sharma had sought a direction from the apex court for the disqualification of the Bihar Chief Minister, alleging that the Janata Dal (United) chief allegedly did not disclose in his election affidavit, an FIR against him in a murder case.
It claimed that Nitish Kumar's membership of the Legislative Assembly should be cancelled as he had allegedly deliberately concealed his criminal past while filing an affidavit in the 2015 Bihar assembly elections. UNI
