New Delhi, Jan 11 : The Delhi High Court Friday refused to quash the FIR lodged against CBI Special Director Rakesh Asthana on bribery allegations.

Justice Najmi Waziri also refused to quash the FIR lodged against CBI Deputy Superintendent Devender Kumar and alleged middleman Manoj Prasad.

The high court directed the CBI to complete investigation in case against Asthana and others within 10 weeks.

The high court further said that the allegation of "mala fide" raised against then CBI Director Alok Verma is not made out.

It also vacated its interim order granting protection to Asthana against criminal proceedings.

Justice Waziri said that permission for prior sanction to prosecute Asthana and Kumar was not required considering the facts of the case.

The high court dismissed the petitions filed by Asthana, Kumar and Prasad challenging the FIR lodged against them. Asthana was booked on charges of criminal conspiracy, corruption and criminal misconduct under sections of Prevention of Corruption Act.

Hyderabad-based businessman Sathish Babu Sana, on whose complaint the FIR was lodged, had alleged having paid bribe to get relief in a case.

Sana had also made allegations of corruption, extortion, high-handedness and serious malpractice against Asthana.

Justice Waziri had reserved the judgement on December 20, 2018 on various petitions after hearing submissions of the counsel for CBI, the Centre, Asthana, Kumar, Verma and Joint Director A K Sharma.              PTI

Lucknow, Oct 5: Taking note of objectionable social media posts in favour of constables allegedly involved in the killing of an Apple executive last week, an FIR has been registered against unnamed people here, while a constable in Raebareli has been suspended in a similar matter, police said on Friday.

After the arrest of two constables, Prashant Chowdhury and Sandeep Kumar, in the killing of Vivek Tiwari on September 29, some people claiming themselves to be their batchmates and sympathisers have launched a campaign on social media in their favour and also sought donations for the accused.

"An FIR has been registered at Hazratganj police station here on Thursday against unnamed people under the Police (Incitement to Disaffection) Act, and cyber teams are looking at such posts to take the case to a logical end," a senior police official said here.

The Act has a provision of maximum punishment of six months against whosoever intentionally causes or attempts to cause or does any act which he knows is likely to cause disaffection towards the government or among the members of police force.

"Rumours are being spread on social media... We have taken the matter seriously and surveillance is going on to track such people. It has come to the fore that some constables terminated from service are involved in it," the DIG said.

He said in one such matter, an FIR has been registered against constable Sarvesh Chowdhury, and he has been suspended and disciplinary action has been initiated against him.

Sarvesh had released an 11-minute video in which he purportedly claims that he had offered and had been collecting money for Prashant and also took swipes at political leaders and top police officials.

Clarifying the situation, the DIG said, "Some people posing as policemen and anti-social elements are involved in it. We will take strict action."

About reports that constables were collecting money to help their arrested colleagues and other such items flooded the social media, DGP O P Singh had yesterday said, "We have alerted our officers and a close watch is being kept on social media. The officers have been asked to interact with constables and tell them about the incident and explain them circumstances under which they were arrested and dismissed."

Vivek Tiwari was shot dead early on September 29 by a policeman when he allegedly refused to stop his car for checking in Lucknow's posh Gomti Nagar neighbourhood.

Two constables, Prashant Chowdhury and Sandeep Kumar, were arrested after an FIR was lodged on basis of a complaint by Tiwari's colleague Sana Khan, who was travelling with him.

New Delhi, Aug 8: The Delhi High Court today dismissed a plea seeking an FIR and a CBI probe against Rajasthan Chief Minister Vasundhara Raje and her son for allegedly getting compensation of Rs 1.97 crore by selling a piece of government land to NHAI for widening a national highway in 2010.

Justice R K Gauba rejected the petition which had also challenged an April 18, 2015 decision of a special CBI court here.

The trial court had refused to order a probe into the allegation against Raje and her son, saying no prior sanction was obtained as required under the Prevention of Corruption Act.

The high court had earlier asked the prosecution counsel to place before him the notification by which the court was set up.

The trial court had dismissed the private complaint by a Rajasthan-based lawyer, saying there was no sanction order to prosecute them under the Prevention of Corruption Act.

According to the petition by lawyer Srijana Shrestha, Raje was not a public servant at the time of the alleged commission of the offence in 2010 and was Leader of Opposition in the Rajasthan legislative assembly.

The petition said Raje and her son had allegedly illegally claimed ownership of a 567 square metre piece of land adjoining the Dholpur Palace in Dholpur town and sold it to National Highways Authority of India (NHAI) for Rs 1.97 crore, causing a loss to the state exchequer.

Thane (Maha), Jul 31: A man has been booked for allegedly duping around 40 people to the tune of Rs 60 lakh by promising to get them jobs at government medical colleges in Maharashtra, police said today.

A Thane city resident, who is one of the victims, approached the police last evening and said in January 2010 he had met the accused (age not known), who claimed to be working on a senior position in a government medical college in Kolhapur.

The complainant, who runs a security agency, expressed desire to expand his business and Bhosle offered to help, claiming that he was an influential person and had contacts with prominent personalities, Thane Police PRO Sukhada Narkar said.

Lured by the offer, the complainant and some of his relatives and friends allegedly paid Rs 1.5 lakh to Rs 2 lakh each to the accused to get work opportunities at medical colleges in Kolhapur, Pune, Nagpur and other places, she said.

The complainant alleged that the accused duped nearly 40 people this way to the tune of Rs 60 lakh, Narkar said.

The police are investigating the matter, Narkar said, adding that no arrest has been made so far.

Jammu, Jul 24: The mysterious death of a man who was detained by police on suspicion of being a cow smuggler in Jammu and Kashmir's Kishtwar district last week has prompted the administration to order a magisterial probe, officials said today.

Javid Ahmad Malik, a resident of Bharat village, was detained by officials of the Chatroo police station on Friday and died the same day. While police claimed Malik fell into a deep gorge when he tried to escape from custody, his family has alleged that he was beaten to death.

New Delhi, Jul 23: Opposition Congress leader Anand Sharma today accused the government of misusing central agencies like the CBI and the ED to settle political scores, leading to an atmosphere of "distrust, fear and terror" in the country.

Raising the issue through a zero hour mention, he said parallel FIRs and multiple cases for the same alleged offence are being registered by the CBI, the DRI and the ED.

"They (agencies) are not instruments to be abused by the government for targeted political vendetta," he said.

Sharma said a distinction needs to be drawn between bonafide decision and actions of corruption.

He went on to allege that investigating agencies were trying to "extract" confessions to implicate certain people.

He, however, did not cite any specific case.

This led to protests from treasury benches with Minister of State for Parliamentary Affairs Vijay Goel stating that Sharma was trying to demoralise investigating agencies.

Chairman M Venkaiah Naidu said legal avenues were available and why was Sharma demoralising agencies.

Sharma said if parallel FIRs for the same alleged offence was an oversight, why was the government silent.

New Delhi, Jul 13: The Delhi High Court today stayed a trial court order directing the Delhi Police to register an FIR against BJP leader Shahnawaz Hussain on a woman's complaint alleging rape.

Justice A K Pathak issued notice and sought the response of the alleged victim and the police on Hussain's plea, challenging the trial court's order passed yesterday.

The Delhi-based woman had, in January, moved the trial court, seeking registration of an FIR against Hussain on her allegation of rape.

The high court, which was initially not inclined to stay the trial court order, later said, "The operation of the trial court's July 12 order to remain stayed till the next date of hearing i.e December 6."

A magisterial court had, on July 7, ordered registration of an FIR against Hussain, saying a cognizable offence was made out in the complaint of the woman. This was challenged by the BJP leader before a sessions court, which had dismissed his plea.

Hussain moved the high court today, seeking a stay on or quashing of the sessions court's order.

Senior advocate Sidharth Luthra, appearing for Hussain, argued that the order for lodging an FIR against the BJP leader had to be quashed as it was a case of complete absurdity.

He also contended that there was a dispute between the woman and Hussain's brother and that the BJP leader got dragged into it.

New Delhi, Jul 2: The Interpol has issued a Red Corner Notice against absconding diamantaire Nirav Modi, his brother Nishal Modi and his employee Subhash Parab on the request of the CBI, probing over USD 2 billion PNB scam, officials said today.

The notice was issued on June 29 but has been made public today by the International police cooperation agency, the sources said, adding that it will make unhindered movement of Modi across border difficult and might lead to his arrest.

The Interpol has issued the Red Corner Notice (RCN) on the basis of charge sheet filed by the CBI in a special court in Mumbai and the arrest warrant issued by the judge Special J C Jagdale there.

In its Red Corner Notice issued against a fugitive, the Interpol asks its 192 member countries to arrest or detain the person if spotted in their countries after which extradition or deportation proceedings can begin.

Modi along with his wife Ami Modi, a US citizen, brother Nishal Modi, a Belgian citizen, and uncle Mehul Choksi, all accused in the CBI FIRs in the case, had left the country in the first week of January, weeks before country's biggest banking scam surfaced.

Nishal and Parab have also been charge sheeted by the CBI along with Nirav Modi and Mehul Choksi for alleged corruption and cheating.

Modi and his uncle Mehul Choksi have refused to return India to join probe citing business and health reasons among others, they said.

In the RCN, Interpol has given details of all the five passports of Modi, issued between May 2008 and May 2017, including that these passports have been cancelled by the government yet he has managed to travel on the basis of revoked and cancelled passports, they said.

The CBI which is the National Central Bureau of India, designated for coordinating with Interpol, has provided it with four addresses of Nirav Modi in tony localities of New York --Manhattan, East Chester and Central and one of Dubai in Al Bayan along with his possible travels to Hong Kong, United Kingdom, Belarus, Brussels, New York, UAE among others, the sources said.

The CBI had tried to track the movements of Nirav Modi through a diffusion notice issued through the Interpol on February 15, but it had limited success as only the United Kingdom responded to the CBI request, they said.

Nirav Modi managed to travel across several countries even after information about his passport being revoked by the Indian government was flashed in the Interpol central database on February 24, the CBI had earlier said.

"After the passport was revoked/cancelled by the External Affairs Ministry, we had updated this information in the diffusion notice. The information that Nirav Modi's passport has been revoked was provided in the Interpol central database, available to all the member countries, on February 24," CBI spokesperson Abhishek Dayal had said.

He had said that after the "diffusion" notice was issued by the Interpol on the request of the CBI, the agency followed it up with six countries where Nirav Modi was suspected to have fled. The agency requested these countries to share information about his whereabouts and movements.

The agency sent these reminders to the Interpol coordination agency of the United Kingdom on April 25, May 22, May 24 and May 28.

Similar reminders were also sent to the agencies of the US, Singapore, Belgium, the UAE and France, they said.

The case pertains to cheating the state-run Punjab National Bank through fraudulent issuance of Letters of Undertaking and Foreign Letters of Credit worth over USD 2 billion (about Rs 13,000 crore) by Nirav Modi and his uncle Mehul Choksi, both absconding since the first week of January.

Modi along with his wife, brother and uncle, all accused in the CBI FIRs in the case, had left the country in the first week of January, weeks before country's biggest banking scam surfaced.

Mumbai, Jun 15: The Bombay High Court today quashed an FIR against actor Armaan Kohli after he submitted an affidavit from jail expressing "remorse and regret" for assaulting his girlfriend.
The court observed that since the victim, Neeru Randhawa, had consented to the quashing of the FIR and did not desire to take the case forward, it was best to quash the FIR.
In the affidavit that Kohli's lawyer brought to court in compliance with its previous order, the actor also assured the court that he will not repeat such behaviour.
Randhawa, who was present in court, also filed an affidavit stating that she and Kohli had decided to amicably settle the matter following the intervention of Kohli's family and their mutual friends.
She also told the court that she has already received some monetary compensation from Kohli's family and that she was to receive some other post-dated cheques from them.
"If the conditions of settlement are met then I will be happy to take back the case," she told the court.
At this the bench permitted that the FIR be quashed and directed Arthur Road prison authorities to release Kohli from custody.
"We hope and trust the petitioner (Kohli) will abide by what is stated in the affidavit in its true spirit," the bench said.
The court also directed Kohli to deposit, as costs, an amount of rupees one lakh each with the Tata Memorial Centre's children treatment centre and The National Association of the Blind within 6 months from today.
Kohli's 90-year-old father and yesteryear film producer, Rajkumar Kohli, was in court but said that he was unaware of the settlement.
The court then put Kohli's brother-in-law, Raman Bhandari, in the witness box, who told the court that the family was aware of the amicable settlement.
Kohli was arrested by the police from Lonavala earlier this week and booked under section 326 of the IPC for voluntarily causing hurt after Randhawa complained to the police that she had been assaulted by the actor.
The Metropolitan Magistrate, Mumbai, rejected his bail on Wednesday and Kohli was remanded to judicial custody.
