Srinagar, Apr 27 :  Reiterating that there is no justification to ask for Central Bureau of Investigation (CBI)  into Kathua rape and murder of an eight-year-old girl in January this year, the Communist Party of India (M) Mohammad Yousuf Targami questioned if the Bar Council of India (BCI) was on the side of victim or accused.
He said there was no justification to ask for CBI probe into the incident.
In a statement here on Friday Mr Targami said that from the media reports , it is understood that when the matter with respect the Kathua incident came up before the Supreme Court of India yesterday, the BCI Committee, filed a report in the matter that the lawyers’ protests for a probe by the Investigation agency into the case was “justified”.
The BCI panel has no authority to submit such a report. The Supreme Court has never directed them to file any such report as to their opinion on justifiability of a CBI investigation of the Kathua case. They were only directed to enquire and find out whether the local lawyers had obstructed the filing of the charge by the police/the trial proceedings, the statement said.
CBI investigation is a demand made by the accused and Hindu Ekta Munch. The accused have no right to demand such investigation. They can’t choose the investigating authority. The attempt of the BCI is to give legitimacy to this illegal demand of the accused and the Hindu Ekta Munch and to influence the investigating officers/police, prosecution and thereby deny fair trial to the victim, Mr Targami alleged.
Majority newspapers in Kashmir today published a press release by Kathua Bar Association (KBA) claiming victory for preventing Crime Branch (CB) of Jammu and Kashmir police to file challan against the accused in the court.
