Jammu, Dec 5: In a much-publicised writ petition filed by social
activist Sukesh C Khajuria seeking registration of FIR against Dr Farooq
Abdullah, former Chief Minister J&K and President National Conference for
his 'pro-freedom speeches' made on December 5, 2016 at Naseem Bagh (Hazratbal)
Srinagar and again on Feb 24, 2017 at party headquarters, Nawa-e-Subh, Jammu
and Kashmir High Court, First Puisne Judge, Justice Ramalingam Sudhakar
directed SSP Srinagar and SHO Nageen to submit response to the petition by or
before the next date of hearing December 21.
Advocate Sheikh Shakeel Ahmed with Advocates Rahul Raina and
Supriya Chouhan on Monday drew the attention of the court towards the latest
Miscellaneous Petition filed by the petitioner Mr Khajuria wherein he sought
directions to the SSP Srinagar and SHO Police Station, Nageen to place before
the High Court the latest status of the inquiry, particularly after the
recording of petitioner’s statement at Police Station, Nageen (Srinagar) on Sep
5, 2017.Advocate Sheikh Shakeel Ahmed further submitted that despite the fact that the statement of the petitioner Sukesh C Khajuria has been recorded by the SHO Police Station, Nageen on September 5, 2017, till date there is no headway into the preliminary enquiry initiated on the complaint of the petitioner.
Advocate Ahmed further submitted that as per the law laid down by the Apex Court in the case titled Lalita Kumari V/s Govt of UP and Ors the SHO was under an obligation to complete the preliminary enquiry within 15 days but till date neither the enquiry has been finalized nor the SSP Srinagar and SHO Nageen have filed response to the writ petition.
Advocate Ahmed further submitted that there is casual approach of the State government as despite service nobody is present on behalf of the State government which clearly shows the non-serious attitude of the state government in a petition of wide public importance.
The Court however, directed the registry to list this petition on Dec 21, 2017 for further consideration. UNI
