Nainital, Sept 5: The Uttarakhand High Court has ordered a CBI probe into the death of tigers at the Corbett Tiger Reserve over the past five years and alleged involvement of forest department officials in the poaching of big cats.

A division bench of the the high court comprising Acting Chief Justice Rajiv Sharma and Justice Lokpal Singh Tuesday ordered inquiry into the death of tigers in the park.

The court also asked the CBI to find out the involvement of forest officers in the poaching of tigers. The matter shall be inquired into and investigated by the CBI and the preliminary report shall be submitted to this court, in sealed cover, within three months, it said.

The CBI is free to take the services of its Wildlife Wing for the probe.

The direction came after the court was told that out of nine tiger deaths in the past only six were natural deaths.

The court does not order for investigation by the CBI but the present case is the rarest of rare cases where the expertise of the CBI is solicited, the court said.

The court further observed that in a period of two and a half years 40 tigers and 272 leopards have died in the state.

As per a newspaper report poachers active in Uttarakhand belong to the Bawariya gang hailing from Haryana.

The Director General of Police is directed to constitute a Special Investigation Team headed by Senior Superintendents of Police to nab these poachers, the court said.

The court further took cognisance of the fact that an area measuring 318.80 hectares falling in Dhulwa and Dhumanda has not been formally included in the Corbett Tiger Reserve.

The State is directed to include this area in Corbett Tiger Reserve within one month.

Issuing various directions to preserve wildlife the court banned the entry of private or commercial gypsies to ply in Dhikala Zone of the reserve thereby modifying previous order of permitting 32 vehicles each to ply in Jhirna as well as in Birjani Zones.

Nainital, Aug 25: The Uttarakhand High Court has slammed the chairman of Central Administrative Tribunal (CAT) for passing a "strange order" on a plea made by the central government seeking transfer of a case, involving whistleblower IFS officer Sanjiv Chaturvedi, to Delhi from the tribunal's Nainital bench.

While quashing the CAT's July 27 order in the matter, the court imposed a cost of Rs 25,000 on the Central government. It also termed as "vindictive" the attitude of the central government.

"The attitude of the respondents towards petitioner, prima facie, is vindictive," said the August 21 order by the division bench of the court, consisting of acting Chief Justice Rajiv Sharma and Justice Manoj Kumar Tiwari.

The bench of CAT had been hearing the case filed by Chaturvedi since July 2017 in the matter pertaining to adverse entries made into his appraisal report of 2015-16 by AIIMS, New Delhi, where he was working as Chief Vigilance Officer from 2012 to 2016.

"It is very a strange order. How the chairman while sitting singly could stay the proceedings pending before the division bench of Central Administrative Tribunal, circuit bench at Nainital," the court order said.

It said the chairman of the tribunal is first amongst equals.

"He exercises the same judicial powers, which are being exercised by the other members. We are of the considered view that the chairman of the tribunal while sitting singly could not stay the proceedings of the matter pending...," the court said.

CAT chairman Justice L Narasimha Reddy had last month stayed for six weeks the proceedings by the tribunal's Nainital bench, in case of adverse entries into appraisal report of Chaturvedi .

Calling the CAT chief's verdict as laconic and non-speaking, it further said the order passed by the chairman while sitting singly is wholly without jurisdiction.

Chaturvedi, who contested the case on his own before the High Court, had in his plea sought quashing of orders of the CAT Chairman and directions to Nainital bench of the tribunal to allow its proceedings.

In his petition before the Uttarakhand High Court, he had alleged violation of natural justice claiming that the stay order was passed when he was away on a mandatory training in Finland and that as per Administrative Tribunal Act, 1985, such ex-parte stay orders can be granted maximum for a period of two weeks while in this case, the chairman had passed stay orders for six weeks.

He had also mentioned CAT rules, which give right to aggrieved officer, to file application at his place of posting.

Chaturvedi had approached Nainital Bench in July 2017 on directions of Uttarakhand High Court, and since then, hearing was going on there.

In September 2017, the bench had given stay in favour of Chaturvedi and on April 17th, this year, in a major judgement, had rejected plea of Cabinet Secretary, to delete his name from list of respondents.

In its order dated July 18th this year, the Nainital bench had ordered that arguments were part heard and the case shall be taken up as first case of hearing on August 27th .

The central government had moved application for transfer of this case, from Nainital to Delhi bench, in December 2017, before the Chairman of CAT, on which the notice was issued.

Nainital, Feb 4: Fifty-year-old Dhondi Ram from Maharashtra, who has just concluded his Uttarakhand leg of Cycle Yatra, is all set to proceed further to complete the Bharat Yatra and set a Guinness Book of World Record.
In Uttarakhand, he spent his three-month-long time to traverse the rural areas of the hills. For this, Dhondi Ram got letters of appreciation from several eminent people of state, including Chief Minister Trivendra Rawat, former Chief Minister Harish Rawat and Finance Minister Paraklash Pant.
Dhondi Ram, a villager from the Jawale village of Sholapur district in Maharashtra, started his cycle journey from Shrinagar in February 2017 and now wants to go up to the southern end -- Kanyakumari. He considers anti-corruption crusader Aanna Hazare as his ideal and feels proud in saying that his village is only 70km away from Anna Hazare’s village Ralegaon Siddhi in Ahemad Nagar district.
Dhondi Ram wants to complete rest of the Yatra in another three years.
When asked about the formalities necessary for setting the world record, Dhondi Ram said that he was maintaining a diary and was recording the names of the places he was visiting.
"At the onset of my journey, the Deputy Chief Minister of Jammu and Kashmir, Nirmal Singh, was present at Shrinagar and all the magistrates of various districts there issued certificates to me regarding the cycle journey," he said.
He showed his certificates from village heads to the cabinet ministers about his cycle voyage to.
Dhondi is quite confident that these documents were more than enough to authenticate his claim for the Guinness Book of World Records of the longest journey on a cycle without breaks.
Prior to claim for the world record, he is also planning to claim for the Limca Book of Records for longest cycle journey in India. To complete the formalities he has already visited the Limca Book of Record’s office in Gurgaon, NCR and got green signal from them. He told UNI.
Dhondi Ram has cycled 87 districts of five states and one Union Territory so far -- Jammu and Kashmir, Punjab, Hariyana, Himachal Pradesh, Uttarakhand and Chandigarh.
After Uttarakhand, he has embarked on his journey to Uttar Pradesh, and then to Delhi, Rajasthan and Madhya Pradesh. The Uttarakhand Chief Minister Trivendra Rawat has written in his letter of appreciation that he appreciated the endeavour of Dhndi Ram. “I appreciate the endeavour of Shri Dhondi Ram and wish him all the success to complete his journey."
The modus operandi is very simple. On entering a city or a district, Dhondi Ram first meets the city mayor or the district magistrate and requests them to arrange his smooth stay in the district. Getting a letter of support from DM makes his journey very easy. He gets food and shelter.
"Apart from the aim of setting the world record, safe driving and respect to the women are other mottos of my cycle journey," he told.
A Law Graduate from Pune University, Dhondi Ram started his journey with only three thousand rupees in his pocket.
He uses an old cycle without breaks in place. He says, it is very difficult to drive cycle without breaks, especially in the hill areas like Uttarakhand, but at the same time, it needs more focus and concentration, consequently, he gives a message of careful driving.
Dhondi Ram is a bachelor and belongs to a nomadic tribe, Dhangar, in Maharashtra.
"I am campaigning for the peace and harmony in the country," he told. UNI
