Badaun, Apr 4: Senior Samajwadi Party leader and former minister Mohammad Azam Khan on Wednesday got a major relief when a local court set aside a sedition case against the leader.
Chief Judicial Magistrate, Badaun, Amarjeet Singh rejected the case of sedition against Mr Khan filed by one Bajrang Dal leader Ujjawal Gupta.
However, the petitioner has said he would go to the Allahabad High Court.
The petitioner alleged that on December 21,2010, Mr Khan had given a controversial statement on Jammu and Kashmir during a demonstration in the district. Gupta had filed a police complaint on December 22 and on January 3,2011 had filed a case in the CJM court under section 156(3) of the CrPC.
The then CJM Pawan Pratap Singh on January 18, 2011 had ordered filing of the case against Mr Khan and asked the police to investigate. But the police submitted an FIR in the case but again the court rejected it and directed the police to re-investigate the case taking in consideration the video recording of the statement of the leader.
But thereafter too, the police gave clean chit to the SP leader saying that the petitioner could not provide the video recording of the statement. UNI
