Srinagar, Nov 4: Reiterating her resolve to protect the special status of Jammu and Kashmir, Chief Minister Mehbooba Mufti on Saturday said that Article 370 is the nation’s commitment to the people of J&K and therefore should be honoured.
The comment by Ms Mufti, who heads the PDP-BJP coalition government, comes four days after Supreme Court (SC) deferred by two months hearing on Article 35A which empowers Jammu and Kashmir legislature to define ‘permanent residents’ of the state.
“Article 370 is the nation’s commitment to the people of J&K and therefore should be honoured,” Ms Mufti wrote on micro-blogging site twitter.
She said that the country should take advantage of J&K’s geo-strategic location and revive its traditional routes to foster greater economic activity.
Asserting that Prime Minister Narendra Modi has an unprecedented mandate and can create history by changing the narrative on J&K, the Chief Minister said that democracy is a battle of ideas and dialogue is the only way forward. UNI

NEW DELHI, AUGUST 11: Chief Minister, Mehbooba Mufti, who is in the national capital, called on the Prime Minister, Narendra Modi here this afternoon.
The meeting assumed significance in view of the raging debate about Article 35-A of the Indian Constitution guaranteeing special position to the residents of Jammu & Kashmir.
The Chief Minister brought to the notice of the Prime Minister the sentiments of the people of the State attached to the special position and also the apprehensions the debate of any abrogation of the same has created in their hearts and minds. She informed the Prime Minister that such debates or demands have a very negative impact on the situational progress in the State which is steadily stabilizing after putting in lot of efforts by the State and Central Governments. “Such debates and demands only vitiate the atmosphere in the State and the country as a result of which people suffer immensely”, the Chief Minister informed Mr Modi.
Terming Article 370 as the basis of constitutional relationship between the State and the Centre, Mehbooba Mufti informed Narendra Modi that the Muslim majority Jammu & Kashmir acceded to the union of India rejecting the two nation theory and consequently due constitutional guarantees were provided to J&K protecting its regional aspirations and character. “The need and urge for protecting and respecting this special status also got amply reflected during my recent interactions with leaders of several political parties in the State”, she informed the Prime Minister.
 Responding positively to the concerns and apprehensions raised by the Chief Minister, the Prime Minister assured the Chief Minister that 'Agenda of Alliance' agreed upon between PDP and BJP should form the basis of any discussion on the State. He also reaffirmed the successful implementation of AoA in the State during the tenure of present Government.
Pertinently, regarding the special status of J&K, the Agenda of Alliance between PDP and BJP clearly states; "While recognizing the different positions and appreciating the perceptions BJP and PDP have on the constitutional status of J&K considering the political and legislative realities, the present position will be maintained on all the constitutional provisions pertaining to J&K including the special status in the Constitution of India."
The Chief Minister had also met the union Home Minister, Rajnath Singh yesterday in this regard.




Srinagar, Aug 9 : The All Parties Sikh Coordination Committee (APSCC) today appealed to all political parties in the state to join hands and defeat the elements who want to change the special status of Jammu & Kashmir by raking up issues like Article 370 and Article 35-A. APSCC is very much concerned about the situation emanating following the reports of alleged tinkering with Article 35-A, chairman of the committee Jagmohan Singh Raina said in a statement adding the debate on it has created a huge row in the state. He said it is the duty of political leadership of Jammu & Kashmir to raise a single voice so that no such step is taken that further threatens the peace and tranquility of the state. He welcomed the meeting between Chief Minister Mehbooba Mufti and National Conference president Dr Farooq Abdullah adding that many more steps need to be taken in this regard. “We all should be united on this issue. The leaders of different political parties should give up ego and work for protecting the special status of the state. If we fail at this point of time then the future generations would never forgive us,” said the APSCC Chairman. Mr Raina said any attempt made to change the special status of Jammu & Kashmir would lead to serious ramifications especially in the Valley. He said the move would hamper the daily life of the valley. Since the state is already up against many odds issues like abrogation of Article 370, Article 35-A would add fuel to the fire. “Many attempts are made by various sections within and outside state to create confusion over serious issues like Article 370. BJP’s stand is clear on the abrogation of Article 370 and the party has been advocating the same since many decades now. Now when the party is in absolute majority in Lok Sabha and beginning to show its strength in Rajya Sabha, it wants to abrogate Article 370 and Article 35-A. All this would be done at the cost of law & order situation in Kashmir,” Mr Raina warned. He said Sikhs in Jammu & Kashmir have suffered right from 1947 and the community members have been further uprooted economically and politically for the last 28 years. Both the Central and the state governments have never bothered to redress the issues faced by the Sikhs in the state. It is the minorities that face the unrealised brunt of such troublesome situations, but despite this Sikhs are concerned and stand by Kashmiriyat. The APSCC Chairman said arrest of Hurriyat leaders like Shabir Ahmad Shah, Naeem Khan, Altaf Ahmad Shah, Shahid-ul-Islam and others along with the sons of Syed Ali Shah Geelani without letting the public know about the charges, will further add venom to these political differences. 'Special GST' to safeguard JK's Consolidated Fund,
 Special Taxation Powers: Dr Drabu
SRINAGAR, JULY 05: The Resolution on GST was passed by both the Houses of Legislature today amid assurance from the Finance Minister, Dr Haseeb Drabu that implementing Goods and Services Tax (GST) in J&K under the ambit of Article 370, ensuring adequate safeguards for the States Special Status and protecting Consolidated Fund and special taxation powers of the State Government are proposed to be incorporated into the Presidential Order for bringing Jammu and Kashmir under the ambit of the new tax regime.
Responding to the concerns of the legislators in J&K Assembly who spoke about the new indirect tax regime over the last two days, Finance Minister, Dr Haseeb Drabu said under no circumstances will the State Government amend the Section 5 of Constitution of J&K which gives it special taxation powers. He said such a move will open a Pandora's Box which will have implications on the Special Constitutional Position of J&K in future.
"We are proposing that the Article 370 shall not be compromised in any way through the Presidential Order. The GST Council should not be a way to subvert the process and enough safeguards are built to empower the constituents of J&K in the Council.  Besides, the exclusive powers of the State to tax and the Consolidated Fund of J&K shall not be impaired," he said.
Expressing concern about declining trade in J&K due to uncertainty over GST, Dr Drabu said only 1000 truckloads of goods crossed the Lakhanpur Toll Post on July 4, down by half when compared with the figures of the corresponding period of last year. "The exports have also halved with only 150 truckloads of goods moving from J&K to other states. This is adversely impacting our trade and economy," he said. 
The Finance Minister said the State Government is not under any pressure to extend GST to Jammu and Kashmir. "We are not working under compulsion but for the restoration of certain processes and constitutional morality which lays foundation of a true democracy. It is the biggest tragedy of our time that we have lost our tradition of dialogue which is why we brought the resolution for GST to the House to revive that culture of consultation. We wanted a consensus on the issue," he said.
Dr Drabu said the resolution on GST, which was passed by the House today, is a statement of a principle. "The sense of the House is that no one has issues with GST per se. There might be differences with modalities of applicability which is why we want this law to be backed by the State Government and legislative process so as to prevent any harm to the consumers and trade without compromising on the States special position," he said.
Hitting out at the Opposition for making an issue out of a non-issue, Dr Drabu said the new indirect tax regime is the biggest democratization of public funds in the world and J&K, being a consumer state, will immensely benefit from it.
"We are not touching the Constitution of J&K, so where is the question of violation of basic structure of constitution?  Under previous regimes, 94 out of 97 items in union lists have been made to apply to J&K. The Opposition can't keep on deceiving people by trying to create misconceptions vis-à-vis JKs Special Status. The Congress issued Presidential Order in 1986 to essentially make laws for the state. After the 1986 ordinance which was effectively the withdrawal of residuary powers of the state, three months later, National Conference formed the Government in the State with Congress," he said.
The Finance Minister said the GST Council is the first truly federal institution in the country which strikes at the roots of Indian federalism. India is moving from coercive to cooperative federalism. The Opposition is selectively looking at the loss of powers of states but not one is looking at the loss of powers of union to the GST council, he said.
Dr Drabu said the Article 370, which gives Special Status to J&K under Indian Constitution, should be protected and used for development of the state and for the empowerment of people. "Instead, it is being used as a tool to whip up political passions and draw political mileage. It is being used for creating fake controversies, he said. Seeking to allay the fears of business community, he said industry exemptions and tax remissions will continue both from the Centre and the State Government under the new tax regime.
Reacting to the demand of the Opposition to bring a separate GST law for Jammu and Kashmir, Dr Drabu said alternative law will require amending Constitution of J&K and of India. "Amending Section 5 of J&K Constitution will open Pandora's Box. Instead, what we are proposing is that the GST Council must come within the ambit of Article 370," he said.
Later, the Finance Minister made similar assertions in the Upper House regarding GST.
After the assurance of Dr Drabu, both the Houses passed with voice vote the Resolution on extension of GST to J&K.
This House resolves that the Government of Jammu and Kashmir may give consent to the adoption of the GST regime by application of relevant amendments made to the Constitution of India in a modified manner to safeguard the existing special constitutional position of Jammu and Kashmir in the Union of India and the legislative powers under the Constitution of Jammu and Kashmir, the resolution which was moved by Dr Drabu in the legislature yesterday states.

Earlier, several members from both the treasury benches and the opposition participated in the debate in both Houses on GST Resolution.
