SRINAGAR, SEPTEMBER 13: During a routine inspection of show-room/workshop of authorized dealer of Maruti Suzuki India Limited at Hyderpora, Srinagar, namely M/s JamkashVehicleades, the spare-parts and other vehicle accessories were checked for mandatory declarations as are required to be printed on the label by the Manufacturer/Packer/Importer under Legal Metrology (Packaged Commodities) Rules, 2011.
It was found that certain imported products like Reverse Assist System (Display Slash Camera) carrying an MRP of Rs 9700/-, was without a mandatory declaration of country of origin and the size of the camera was given in Non-Metric units. Under the aforesaid rules, every imported product must carry on its label the country of origin for the awareness and knowledge of a consumer. Usage of Non-Metric units for size/net contents is a serious offence.
A Legal Notice was served to the company and the company in response to the notice confessed to the lapse and requested for compounding of the offence departmentally instead of referring it to the court of law. Dy. Controller Legal Metrology Department slapped a penal sum of Rs 50,000/=for the lapse.

BARAMULLA, SEPTEMBER 11: Legal Metrology Department Baramulla has launched a massive anti-profiteering drive in the district after the decision of the Government of India with regard to reduction of Goods & Services Tax (GST) on various goods and services. 
          The drive included a check on footwear, sanitary napkins, paints and varnishes, electronic goods and other packaged goods.
“During the inspections, it was observed that while manufacturers of the goods that were checked have revised their maximum retail price and affixed stickers on the packages with revised lower MRP, the retailers are taking an undue advantage of the peculiar situation and are not always passing benefits of GST reduction to consumers,” a statement of the LMD said. 
Taking cognizance of the offence, Legal Metrology Officer Sopore booked a pharmacy for not passing benefits of GST reduction to consumers in the sale of sanitary napkins which have now been exempted from GST.
In Baramulla, a case was booked against a mobile phone dealer by the Legal Metrology Officer Baramulla for overcharging on mobile phones.
The LMD Baramulla has asked the traders to pass on benefits of GST reduction to the consumers wherever applicable.

KISHTWAR SEPTEMBER 07: During routine checking of business establishments of Kishtwar and adjoining areas, Legal Metrology Department (LMD) Kishtwar booked 6 traders for violation of labeling norms and less quality in pre-packaged containers.
A composition sum of Rs. 18700 was realized from the offenders as fine with the assurance not to repeat it in future.
The department directed the traders to use only certified weighing and measuring instruments in commercial transactions and refrain from fraudulent trade practices.

SRINAGAR, AUG 01: The field executives of Legal Metrology Department booked two cooking gas distributors for delivering the re-fill cylinders of LPG to the consumers before weighing them on the scale. Under Legal Metrology (Packaged Commodities) Rules 2011, every delivery boy of cooking gas cylinder has to keep an electronic weighing scale of 50 kg available in the van and has to weigh the cooking gas on it before supplying it to the consumer. In case, the cooking gas cylinder is lesser in weight of gas by more than 150g, the cylinder is required to be sent back to the bottling plant for re-filling.
Moreover, it was observed that the delivery-boys were distributing gas without checking the leakage of the gas valve, A penal sum of Rs.7000/- was slapped on the erring delivery boys.
The rate for 14.2 kg gas for the month of August 2018 for district Srinagar, Budgam, Pulwama and Anantnag has been fixed at Rs 914/- of which subsidy component is Rs 386/- The consumers may lodge their genuine complaints on the toll-free No 1800-180-7114 or on 0194-2490390 during office hours in case any delivery-boy overcharges on refill cylinder or delivers gas cylinder without weighing it. The consumers should also insist for weighment of gas/cash-memo/leakage checking of cylinder.

REASI, JULY 31: The Legal Metrology Department has charged Rs 24400 fine from 12 traders for unfair trade practices.
To check unfair trade practice, overcharging and other violations, the Enforcement team of Legal Metrology Department conducted extensive inspection of various Restaurants/eateries, dry fruits & Parshad shops, gift item shops and others business establishments here at holy town Katra and enroute to Shree Mata Vaishno Devi Ji bhawan.
The team imposed a fine of Rs 5000 each on a leading Restaurant, a Milk product shop and a Flour Mill based at Baribrahmana and Rs 2000 on a Gift house etc. for violation of various provisions of Weights and Measures Laws.
Traders were warned of stern legal action in case of any further indulgence in anti- consumer practices. They were further directed to use only verified Weights and Measures and to sell packaged commodity clearly mentioning MRP, Packing date, Net weight, complete address of manufacturer/packer along with consumer helpline no.
It is pertinent to mention here that during this month the department has booked 23 defaulters and realized fine of Rupees 48900.

KISHTWAR, JULY 31:  Legal Metrology Department (LMD) fined 25 traders after they were found flouting certain provisions during a market checking launched on the eve of Machail Yatra.
A team of Legal Metrology, under the supervision of Assistant Controller conducted extensive market checking in Kishtwar town and its peripheral areas including Padyarna, Karthai, Kajai, Kundal, Atholi, Gulabgarh and adjoining areas of Paddar.
The team charged Rs Ten thousand from 25 erring Traders for violation of J&K Weights and Measures Enforcement Act and Rules.
The team directed the traders to use only verified weighing and Measuring Instruments and charge as per MRP printed on the packaged items from the consumers.

SRINAGAR, JULY 28:  The field executives of Legal Metrology Department (LMD) Srinagar in coordination with the Assistant Controller Legal Metrology Bandipora conducted a three-day visit of Baqtoor, Gurez and Tulail under the supervision of Joint Controller Kashmir Amar Singh.
During the visit, markets of Gulshanpora-Baqtoor, Rufuji-pora, Izz-Marg, Kanzalwan, Dawar, BurnoiBudugam, Malngam,Husungam, Sheikhpora, Baduaabetc were inspected. Around 20 erring traders were booked for violation of Legal Metrology Laws.
The nature of offences found was short-weighments, over-charging, use of unverified commercial weights and measures, offering for sale packaged commodities of edible oils, spices, dry-fruits without adequate labelling.
The erring traders were penalized and a penal sum of about Rs 20,000 was collected.

BARAMULLA, JULY 11: Legal Metrology Department Baramulla penalized a tile manufacturer with a fine of Rs. 30000 for manufacture and sale of tile packages violating labelling norms.
Earlier, a case was registered against the manufacturer by Legal Metrology Officer Sopore after the tile packages were found to be without the complete address of the manufacturer/ packer and consumer care details.
Further, the packages were found to have statutory declarations of retail sale price and date of manufacture/ packing mentioned by way of using a rubber stamp which is against the provisions of the Legal Metrology (Packaged Commodities) Rules, 2011. The matter was brought into notice of the manufacturer who in turn admitted the lapse and requested for compounding of the offence.
Ultimately, Assistant Controller Baramulla imposed the fine on the manufacturer after taking an assurance that the offence will not be repeated in future. 
All the manufacturers, packers, importers and dealers of packaged commodities are advised to adhere to the labelling norms, as provided under Law, on their packages so that the rights of consumers are not violated in any manner. Besides, consumers of District Baramulla are requested to register their genuine grievances with the Department for speedy and proper redress at email ID: aclmbaramulla@gmail.com.

KISHTWAR, JUNE 29:   Legal Metrology Department, Kishtwar has booked 19 erring traders for violation of various provision of law.
The departmental teams conducted extensive market checking in Kishtwar and peripheral towns Sarthal, Chatroo, Mughal Maidan and booked 19 Traders for trade violations.  The team recovered Rs 24000 (twenty four thousand only) as fine from the earning traders.
Meanwhile, the traders were directed to use only verified weighing and measuring instruments abstain from indulging in unfair trade practices.

JAMMU, JUNE 01: The government today asked the CBSE affiliated schools to comply with the orders of district consumer forum and refrain from ‘sale as well as referring of particular book sellers to the parents/students for purchase of note books, books, uniforms and other stationery materials studying in their schools.’
Joint Controller Legal Metrology V. S Sambyal cautioned the school heads and owners that violation of directions of District Forum will invite contempt proceedings against them.  The LMD department had convened a meeting   with management of CBSE affiliated schools, civil society members and Consumer activists here to intimate them about the judgement delivered by chairman District consumer Forum Jammu.
 The Forum in its order banned sale as well as referring of particular book sellers to the parents/students for purchase of note books, books, uniforms and other stationery materials studying in their schools. The judgement has been dispatched to all CBSE affiliated schools for implementation.
Jt Controller informed that any school who has not received the judgement can collect the same from his office for implementation. He hoped that the schools shall voluntarily comply with the judgement.
Failure to comply with the judgement will amount to contempt proceedings.
LMD asked the schools to comply with the judgement within week’s time
“After the lapse of scheduled time, departmental Squads will conduct inspections alongwith consumer activists and shall initiate contempt proceedings against defaulters”the meeting was told.
The meeting was attended by prominent consumer activists Des Raj Danish, President Consumer Protection organization, S. K Gupta President Consumer Welfare Association and management members of CBSE affiliated schools.

Directs Oil Companies to maintain adequate stock, ensure timely delivery of LPG cylinders
SRINAGAR, MAY 29: In order to regulate the supply of LPG, Minister for Food Civil Supplies & Consumer Affairs (FCS&CA), Mohammad Ashraf Mir, today convened a meeting with representatives of oil companies and concerned officers to review the status and supply of LPG stock in the state.
The meeting was attended by Secretary FCS&CA, Dr Abdul Rashid; Director, FCS&CA (Kashmir), Nisar Ahmad Wani; Controller LMD R K Katoch; Director LMD Jammu and representatives of oil marketing companies including Bharat Petroleum, Hindustan Petroleum, Indian Oil Corporation and other concerned representatives.
The Minister was informed that around 4,80,000 LPG connections have been issued in the state under Pradhan Mantri Ujjwala Yojana (PMUY) up to March 31 this year and around 1 lakh connections have been issued from April 1.
The Minister directed that PMUY should be implemented in letter and spirit and it should be ensured that all the beneficiaries are covered under this scheme. He directed the concerned to cover 100% households with LPG connections.
Mir while taking stock of existing supply of essential commodities in the state directed for ensuring adequate availability of essentials to snow-bound areas in the state. He directed the companies to maintain a contingency stock of LPG so that the local populace does not suffer, mainly in far-flung areas.
Stressing upon strengthening the door-to-door delivery of LPG within shortest possible time, he directed the representatives of oil companies to ensure 100% home delivery in every nook and corner of the state, particularly in far-off areas and snow-bound areas.
While discussing the allotment of LPG gas agencies, the Minister directed that the process should be made transparent and quick so that the delivery of LPG is ensured to all.
On the occasion, the concern regarding the lack of petrol pumps at various stretches of roads especially on newly constructed highways was also discussed. The Minister directed the officials to conduct an extensive survey of various areas that lack petrol pumps so that the same can be set up for better services to the motorists.
The Minister also asked the representatives of the oil companies to utilize their CSR for public good especially for consumer welfare in consultation with the government.

SRINAGAR, MAY 25: In response to a complaint of underweight packages of edible oil available in Srinagar markets, a team of Legal Metrology officers headed by Dy. Controller (Enforcement) today conducted a surprise inspection of wholesale dealer at Batamaloo, Moominabad and Hyderpora markets here.
The inspection found the oil packages marketed under Kamal brand to be underweight with variations ranging from 100g to 200g.
The department seized the brand stocks worth one lac rupees and registered a case against the manufacturer serving it a notice through its dealer in Srinagar.

JAMMU, MAY 23: The market checking squads of Legal Metrology have charged Rs 86,300 fine from 83 business operators during massive market checking drive launched to keep check on quality of food and rates during the holy month of  Ramzan.
The teams conducted checking of business operators dealing with meat, poultry, vegetables, fruits,  milk products etc in different districts of Jammu province.
The checking squads booked  95 business operators of which 83 business operators confessed to the violations of various types. They were   compounded for Rs 86,300.
Meanwhile, the checking squads also destroyed   rotten vegetable, cheese and other eatables.

JAMMU, MAY 21: Intensifying its drive to keep check on the price and quality of various commodities in view of ongoing holy month of Ramzan, Enforcement Wing of Legal Metrology department inspected various establishments, here today.
The team headed by Assistant Controller, Ajay Kumar Verma conducted surprise checking of business establishment in various localities including Karan Market Jammu, BC Road, Maheshpura Chowk, Amphalla, Sarwal, Janipur, Thather, Akhnoor and adjoining Areas.
Business establishments of meat sellers, chicken, vegetable, fruit, bakery, sweets, LPG dealers, utensils shops were inspected for their compliance with regards to various provisions of J&K Standard of Weights and Measures Enforcement Act 2011(Amended) and packages Commodities rules.
17 traders were booked and penalty of Rs18000.00 was imposed on12 traders for violations of the act and notices were issued to the remaining traders.
The Department also directed the traders to use weighing and measuring instruments duly verified and authenticated by the LMD and ensure that   Maximum Retail Price(MRP), Date of Packing (PKD), Net Contents and complete address of the Manufacturer/ Packer andconsumer care number have been declared onthe commodities to be sold in package form as per Legal Metrology Package commodities Rules 2011.
The Department also warned the unscrupulous traders to desist away from using unfair trade and anti-consumerspractices while it appealed the consumers to remain vigilant while purchasing the commodities especially during the festival seasons.

SAMBA, MAY 18: The Legal Metrology Department has fined a Punjab based Rice Packing Firm for violating Legal Metrology (packaged commodities) Rules 2011.
 The firm was in practice of packing rice bags of various denominations for sale in the market without mandatory declarations being printed such as MRP Rs....(inclusive of all taxes), month/year of packing, customer helpline etc.
A legal notice was served to the management of the firm based on offence reports submitted by the Inspector Legal Metrology Samba Mohsin Khateeb. 
The management of the said firm confessed the guilt and pleaded before the Assistant Controller LMD Samba. On written submission, the defaulter company was compounded and a sum of Rs.25000 was charged as fine.

SRINAGAR, MAY 8: Minister for Food, Civil Supplies & Consumer Affairs (FCS&CA), Mohammad Ashraf Mir today held a meeting to review the functioning of the Legal Metrology department here.
The meeting was attended by Secretary, FCS&CA, Dr Abdul Rashid; Director, FCS&CA (Kashmir), Nisar Ahmad Wani, Controller, LMD, J&K, R K Katoch and other concerned officers of the department.
On the occasion, the Controller LMD briefed the minister about the functioning of the department. While enquiring about the achievements, the minister was informed the department has recovered Rs 86.42 lakh from 6721 violators in the state as penalty in 2017 – 2018.
"Besides, Rs 1.87 Crore was recovered as stamping fee on account of verification of commercial weights and measures from the violators," they said. The Minister was also briefed about various state and centrally sponsored schemes with regards to the ongoing construction works in the department.
Appreciating the efforts of the department, the minister asked the officials to be polite and gentle while carrying out their professional duties. He stressed that the stakeholders should not be subjected to any kind of harassment while conducting market checks
"However, there should be close vigil on market violations. The interest of the consumers should be of paramount importance while you discharge your duties. You should come up to the expectations of the people," he said.

SAMBA MAY 02: A team of officers from Legal Metrology Department under the supervision of Assistant Controller, Rajesh Heera, today conducted a surprise raid on various industrial packing units in Samba in which one of them was found violating Legal Metrology Packaged Commodities Rules 2011.
The unit was packing the material without mandatory declarations such as name of commodity, net content in standard units, month/year of packing, customer helpline etc. on them which is a sheer violation of Legal Metrology Packaged Commodity rules, 2011 and is a  serious lapse on part of the management of the packing unit.
The erring packing unit was booked and Assistant Controller, Rajesh Heera after assurances from the defaulting trader of not repeating any kind of offence under law, compounded the case and slapped a fine of Rs20000. In other two cases, a fine to the tune of Rs. 10000 each was also realized from the violators of other provisions of legal Metrology Laws.

KATHUA, MARCH 26: A team from Legal Metrology Department Kathua and Sub-District Administration Billawar comprising of Tehsildar Vishvajeet Singh, Assistant Controller Jaidep Singh Sambyal and Inspector Pritam Chand inspected a private school at Phintar and seized book sale counter opened by the school management in collaboration with a Jammu based Book seller. Various stationary items not carrying mandatory declarations such as MRP, No. of pages on notebooks, Size, name and address of publisher etc were seized.
The Asstt Controller Legal Metrology Kathua Jaideep Singh Sambyal stated that with the commencement of academic session 2018-19, complaints from parents against private educational institutions poured   in particularly regarding to forced sale of Books and stationary items which is a unfair and restrictive trade practice. He added that students were allegedly forced to buy notebooks bearing name of a particular school which is a violation of right to choose under J&K Consumer Protection Act where under every consumer  has right to  choose among  variety of goods and services available in a competitive market.
The Inspector Legal Metrology Dayalachak Prittam Salaria booked the School Management under relevant Act and rules.
The Asstt Controller Legal Metrology Kathua Jaideep Singh Sambyal  on the undertaking given by School management that it will not violate any of the provisions of the law compounded the case and imposed a fine of Rs 50000.
The team of Officers also appealed the managements of all private schools to desist from such kind of practices failing which Department shall taken stern punitive action against all such defaulting institutions.   
 The team of Officers also appreciated the parents of children who approached the Department with such complaints.

SRINAGAR, MARCH 16: Legal Metrology Department (LMD) today imposed a fine of Rs 10,000 against a readymade garment store for selling school uniforms without proper labelling.
The fine was imposed after the department received a complaint from a customer that a readymade garment store at Lal-Chowk was selling the school uniforms without proper labelling.
Under Legal Metrology laws, every ready-made garment in packed form must carry the obligatory declaration of MRP (Inclusive of all taxes) , Size in centimetres (cm), description of product, customer care details, month and year of manufacture and name of the manufacturing company/ packing firm/marketing agency with complete address.

SAMBA, JANUARY 23: Department of Legal Metrology today organized a Consumer awareness programme at Government Higher Secondary School Nud.
AC Legal Metrology Ajay Kumar Verma informed the Students and Consumers about their rights and duties while purchasing day to day goods from the market. They were made aware about the precautions they need to take while purchasing various goods and ways to check the authenticity of various weights and Measures used by various traders during business transactions.
They were also informed about Gas cylinder rules and importance of checking the retesting date on cooking gas cylinder as the cylinders are tested by the respective Oil Companies periodically for strength and durability of Cylinder.
The Department also informed the gathering to check the mandatory declaration like Maximum Retail Price (MRP), Date of Packing(PKD), complete address of the manufacturer/ Packer, Net weight of the Commodity, name of the commodity and customer care number on the pre- packed commodities before purchasing these commodities.
It was also given out in the programme that similar activities are being organized across the district to spread awareness  among people. 

Among others, Principal Sudesh Kumari, Inspector LMD Mohsin Khateeb and staff members were present on the occasion.
