The Supreme Court Thursday dismissed a petition seeking directions for the immediate execution of the four men convicted in the Nirbhaya gangrape and murder case of 2012. "What kind of prayer you are making?" a bench of Justices Madan B Lokur and Depeak Gupta said. "You are making the court a joke," it added.


New Delhi, Dec 13 (PTI) The Supreme Court Thursday dismissed a petition seeking directions for the immediate execution of the four men convicted in the Nirbhaya gangrape and murder case of 2012.

"What kind of prayer you are making?" a bench of Justices Madan B Lokur and Depeak Gupta said. "You are making the court a joke," it added. 

The 23-year-old paramedic student was gangraped on the intervening night of December 16-17, 2012 inside a running bus in South Delhi by six persons and severely assaulted before being thrown out on the road. She died on December 29, 2012 at Mount Elizabeth Hospital in Singapore.

On July 9, the apex court dismissed the pleas of three convicts -- Mukesh (31), Pawan Gupta (24) and Vinay Sharma (25) -- seeking review of the apex court verdict which upheld the judgements of the Delhi High Court and the lower court in the case.

The fourth death row convict, Akshay Kumar Singh (33), has not filed a review plea in the apex court.

A 22-year-old woman was allegedly abducted and raped by three men in the district, police said Thursday.


Muzaffarnagar, Dec 13 (PTI) A 22-year-old woman was allegedly abducted and raped by three men in the district, police said Thursday.

The incident took place Wednesday when the woman's parents were not present in the house. She was later found in the nearby fields and narrated her ordeal to her parents, Statio House Officer Santosh Kumar said.

The accused also filmed the act and threatened the woman of dire consequences if she revealed the matter to anyone, he said, adding that police are searching the three men who are absconding.

Muzaffarnagar, Oct 13 (PTI) Following the brutal gang-rape and murder of a 17-year-old Dalit girl, the police have taken several suspects into custody for questioning, officials said on Saturday.

The minor girl was raped by three men in Lank village in Shamli district of the state on Wednesday. The accused then murdered the victim by hanging her from a ceiling.

Several people have been taken into custody and are being quizzed about the incident, a police official said.

Muzaffarnagar, Oct 12 (PTI) A 17-year-old Dalit girl was allegedly raped and killed by three persons when she was alone at her house in Uttar Pradesh's Shamli district, police said Friday. 

Based on a complaint by a family member of the girl, a case was registered against Sanoj Kumar, Jaivir and Sonu Thursday, Additional Superintendent of Police Ajay Pertap said.

The girl's body was found hanging from a ceiling fan in the house, the officer said.

She was alone in the house as her parents had gone to Panipat, he said.

The matter is being investigated and a search was launched to nab the accused, Pertap said.

New Delhi, Oct 5: The Supreme Court Friday dismissed a plea by an accused in the sensational Kathua gang rape and murder case seeking fresh investigation in the matter on grounds that the probe conducted earlier was allegedly motivated.

A bench of Justices U U Lalit and D Y Chandrachud also dismissed a separate plea filed by two other accused in the case seeking transfer of the investigation in the matter to an independent agency.

The bench, while rejecting both the pleas, said the accused could raise this issue before the lower court during the ongoing trial.

The state police's crime branch, which probed the case, filed the main charge sheet against seven people and a separate charge sheet against a juvenile revealing chilling details about how the minor girl was allegedly kidnapped, drugged and raped inside a place of worship before being killed. (PTI)

Muzaffarnagar, Aug 11: A 23-year-old gang rape victim allegedly tried to commit suicide over police inaction at a village in Uttar Pradesh's Shamli district.

The woman attempted to end her life by consuming poison yesterday, Station House Officer (SHO), Jhinjhana, Rajkumar Sharma said.

Two people are accused in the case and one of them was arrested yesterday. The woman is undergoing treatment at a hospital, the officer said.

Family members claimed that she was upset over the police not taking adequate action against the perpetrators.

The woman was raped by the youths on August 5, according to the complaint lodged by her father.

He has also alleged that the youths had threatened his daughter with dire consequences if she reported the matter, the SHO said.

Sharma said the matter is being investigated and a search had been launched to nab the other accused. (PTI)

Hyderabad, Aug 10: A 28-year-old woman was allegedly raped by four men in Guntur district of Andhra Pradesh, the police said today.

The woman, who lives in the S R Nagar area here, told the police that the incident took place in March, but she did not approach the police then, they said.

As her pictures appeared online recently she lodged a formal complaint with the police, DCP (West Zone) A R Srinivas said.

In her complaint she said one of the accused, Raj Kiran, known to the her, took her to a room in Guntur on the pretext of a job and offered her drinks laced with sedatives following which she fell unconscious and when she gained consciousness she found that she had been raped by the four men, the DCP said.

A case of gang rape has been registered and as the alleged offence took place in Guntur, the case will be transferred to the Guntur police, Srinivas said, adding that as per preliminary investigation there are also allegations of a financial dispute between the woman and Kiran and that angle is also being probed. (PTI)

New Delhi, Aug 8: The Supreme Court today sought response from the Jammu and Kashmir government on a plea by Talib Hussain, a key witness in the sensational Kathua gang rape-and-murder case, alleging custodial torture by the state police in an alleged fake rape case.

A bench headed by Chief Justice Dipak Misra considered the submission of senior advocate Indira Jaising that Hussain had been brutally tortured in police custody and judicial intervention was needed.

The bench also comprising Justices A M Khanwilkar and D Y Chandrachud asked the senior lawyer to explain as to how a writ of habeas corpus (produce the body) can be filed in the present case as the accused, Hussain, is in lawful custody of the police.

Jaising referred to a Supreme Court judgement and said that such a petition can be filed even in case of custodial torture.

The bench asked the state government to file the response in a week and asked the lawyers to serve a copy of the petition on the advocate general of the state.

It also permitted the woman, who had lodged an FIR against Hussain alleging rape, to file an application seeking to intervene in the matter.

The bench posted the matter for further hearing on August 21.

The court was hearing the submission of a close relative of Hussain, seeking urgent hearing on the plea.

The relative of Hussain sought his protection in police custody and alleged that he had been brutally beaten up in the alleged fake rape case.

The habeas corpus writ petition, filed by a cousin of the witness, alleged that Hussain had been kept in illegal detention and was being subjected to custodial torture.

Hussain is a key witness in the Kathua case, in which an eight-year-old girl from a minority nomadic community was abducted and gang-raped in January.

The state police's crime branch, which probed the case, filed the main charge sheet against seven people and a separate charge sheet against a juvenile. (PTI)

Pratapgarh (UP), Jul 31: A 17-year-old girl was allegedly raped by three men while another of their associate recorded a video of the act in Lalganj area here, police said today.

The girl, a resident of Jevai village, was returning home from market when the men lured her into accompanying them on their motorcycle last evening, Circle Officer, O P Dwivedi said.

The accused took the girl to a secluded spot and took turns to rape her, the CO said, adding that another of their associate recorded a video of the incident.

On the basis of the complaint of the girl's father, an FIR was lodged and three of the accused arrested.

The girl was sent for medical examination, the CO added. (PTI)

Jammu/Pathankot, Jul 30: The eight-year-old girl from Kathua, who was gang-raped and killed, was overdosed with a cocktail of sedatives through her captivity,"rendering her incapacitated" to resist sexual assault and murder, states the supplementary charge sheet filed by Jammu and Kashmir's Crime Branch today.

The charge sheet filed in the Pathankot sessions court sums up the investigation of the Jammu and Kashmir Police's Crime Branch team and also gives details of the analyses of calls and bank accounts that led it to the eight accused of the brutal crime in January this year.

The supplementary charge sheet was submitted by a Crime Branch team -- led by Senior Superintendent of Police R K Jalla and special public prosecutors J K Chopra and Santokh Singh Basra, Bhopinder Singh and Harminder Singh -- before Pathankot District and Sessions Judge Tejwinder Singh.

"We have submitted the supplementary charge sheet, giving details of call analyses, bank details and medical reports," special public prosecutor Chopra told.

The charge sheet lists in chilling detail the sedatives, including cannabis, forcefully given to the child from a minority nomadic community, who was abducted on January 10 and allegedly kept in captivity for three days. She was killed on January 14 and her body was found in a forested area near Kathua on January 17, officials said.

During the course of the investigation, "it has been established that the victim was administered sedatives by accused during her captivity", the charge sheet states.

She was given 'mannar' (believed to be local cannabis) as well as Epitril 0.5 mg on an empty stomach, it says.

"She was forcefully administered five tablets of Clonazepam of 0.5 mg each on January 11, 2018 which is higher than the safe therapeutic dose. Subsequently more tablets were given...The signs and symptoms of an overdose may include drowsiness, confusion, impaired coordination, slow reflexes, slowed or stopped breathing, coma (loss of consciousness) and death," according to the medical expert's report submitted along with the charge sheet.

The peak concentration of Clonazepam is achieved in the blood after "one hour to 1.5 hours" of oral administration and its absorption is complete "irrespective of (whether it is) administered with or without food", states the report.

It says the tablets given to the eight-year-old could have pushed her into a state of shock or coma.

"... the expert opinion coupled with other evidence that has come on record prima-facie establishes that the victim child was continuously administered overdose of Clonazepam (Epitril) rendering her incapacitated to resist rape and murder," the charge sheet says.

The Crime Branch has arrested Sanji Ram, custodian of a temple where the child was allegedly confined, his son Vishal and his juvenile nephew, two special police officers Deepak Khajuria alias 'Dipu' and Surender Verma and friend Parvesh Kumar alias Mannu. All of them were named in the first charge sheet on April 9.

It also arrested head constable Tilak Raj and sub-inspector Anand Dutta, who allegedly took Rs 4 lakh from Ram and destroyed crucial evidence. Raj and Dutta have since been dismissed from service.

The supplementary charge sheet highlights the efforts of Vishal and his father Ram, alleged to be the mastermind behind the crime, to create an alibi. They were allegedly trying to show that Vishal had never visited Kathua was actually taking an exam on January 15.

It says Kumar was not only in constant touch with Khajuria but also in contact with Raj, who is alleged to have played a pivotal role in striking a deal between the police and Ram for destruction of evidence.

The charge sheet has submitted Kumar's detailed call analysis to show he shared a common location with other accused on crucial dates of the crime and immediately thereafter.

The duration of the calls made and their frequency increased after the rape and murder, leading to "irresistible conclusion of knee deep involvement of accused Surinder Kumar with other accused...", the charge sheet says.

The Crime Branch also conducted an analysis of the two bank accounts of Ram and found he had made huge cash withdrawals.

Witness statements recorded by the Crime Branch confirmed the accused had undertaken no constructional activity and had no social obligation either, the document says.

The Crime Branch alleged in its charge sheet that the withdrawals were made to bribe the police officers for destruction of evidence.

A copy of the supplementary charge sheet has been handed to the defence counsel.

Earlier this month, the Crime Branch informed the Supreme Court that it would be submitting a supplementary charge sheet in the case.

The apex court bench, comprising Chief Justice of India Dipak Misra and Justices D Y Chandrachud and Indu Malhotra, had on July 9 given it eight weeks to file the document.

The district and sessions court in Pathankot framed charges of rape and murder against the seven accused in the case on June 8, after the Supreme Court transferred the case from Kathua on a plea of victim's family

Ram, considered the main accused, is alleged to have hatched the conspiracy with the other accused for kidnapping the girl as part of a strategy to remove the minority nomadic community from the area.

The fate of the eighth accused, a juvenile, was yet to be decided after the Crime Branch moved an application in the high court claiming him to be an adult. (PTI)

Morena (MP), Jul 24: A 16-year-old girl was allegedly raped by four men in Madhya Pradesh's Morena district, the police said today.

All the four accused, identified as Sukha Tomar, Sonpal Tomar, Ankit Tomar and Dadua Tomar, were arrested last evening, Nagar police station in-charge Jiten Sharma said.

The accused, aged between 25 to 30 years, abducted the girl on Sunday evening when she had gone out of her house in Kuretha village to attend nature's call.

They took her to a field outside the village where they allegedly raped her before fleeing from the spot, Sharma said.

The girl managed to reach home and narrated her ordeal to her parents, who filed a police complaint yesterday, he said.

All the accused, residents of the same village, have been booked under sections 376(D) (gang-rape) and 363 (abduction) of the IPC and relevant provisions of the Protection of Children from Sexual Offences (POCSO) Act, he said. (PTI)

Chapra (Bihar), Jul 7 :  A class 9 girl has alleged that she was raped and blackmailed by her school's principal, two teachers and 16 students in Bihar's Saran district, police said today.

The principal and a teacher were arrested and four students apprehended for allegedly raping and blackmailing the girl, Superintendent of Police (Saran) Harkishore Rai told.

In her complaint, the girl alleged that she was raped and subsequently blackmailed for seven months by the principal, two teachers and 16 students.

The school is located in Parsagarh village which comes under the jurisdiction of Ekma police station of Saran district, about 35 kms from the district headquarters of Chapra.

The SP has constituted a Special Investigation Team (SIT) under Deputy Superintendent of Police Ajay Kumar Singh, who visited the school yesterday, and made the arrests.

Raids are being conducted to apprehend the other accused, the SP added.

In the complaint, the victim alleged that she was first raped by some of the students of her school in a toilet there in December 2017, Rai said.

The students also recorded a video of the act and threatened her to make it viral if she reported the matter to anyone, he said.

When the victim complained to the principal about the incident, he convinced and persuaded her not to lodge a complaint as the matter would bring disrepute to her and the family, the SP said.

The principal along with two teachers, later, also raped and blackmailed her, the girl alleged.

The victim told reporters today that she could not muster courage to lodge a complaint with the police since her father was in jail for several months.

The girl's father was released from jail a couple of days ago and a complaint was lodged yesterday.PTI

Jamshedpur, Jun 23 : Artistes of Jamshedpur today said they would not perform for 10 days in protest against the gang-rape of five women in Khunti district earlier this week.

In a memorandum to Chief Minister Raghuvar Das, the artistes demanded immediate arrest of all the culprits, stringent action against them, and adequate compensation for the rape victims.

The memorandum was sent through East Singhbhum Deputy Commissioner Amit Kumar by a delegation of artistes from various organisations under the banner of 'Jamshedpur Kalakaar Sangh'.

In the memorandum, they described the gang-rape of five women as "heinous and inhuman" and said artistes across the state were shocked by the incident.

Five women working with an NGO were allegedly raped at gunpoint by a group of at least five men when they had gone to Kochange village under Arki police station area to create awareness on migration and human trafficking on Tuesday.

The artistes demanded that adequate security be provided to them during their performance to ensure that such incidents do not recur, the memorandum said.

They also demanded issuance of identity cards to the artistes.

The artistes appealed to their colleagues across the state to protest against the incident in all district headquarters.

The artistes of Jamshedpur held a meeting here yesterday and decided not to perform for 10 days.

Artistes from across the state would try to meet the chief minister in Ranchi on June 26 over the incident.

Khunti Superintendent of Police Aswini Kumar Sinha has said an FIR was filed on Thursday against unidentified persons involved in the gang-rape, another case was registered against the head of local school where the incident occurred.

The police have identified the culprits and eight people were detained in this connection, he said.

Initial investigation has found that the people behind 'Pathalgarhi' (a practice in which villagers inscribe various tenets on huge stone slabs and ban outsiders in their area), were behind the incident, Deputy Inspector General of Police Amol V Homker had said yesterday. PTI

Khunti (Jharkhand), Jun 23 : The head of the Kochange village school, from where five women working with an NGO were allegedly abducted and later gang-raped, has been booked for not reporting the incident to police, an official said today.

The police have also released a sketch of one of the five accused and announced a reward of Rs 50,000 for providing information about them, Khunti Superintendent of Police Aswini Kumar Sinha said.

While an FIR was filed on Thursday against unidentified persons involved in the gangrape in Khunti district, another case was registered against Father Alfonso Alien at the Arki police station yesterday, he said.

Father Alfonso Alien, who runs the missionary school from where the women were abducted, was detained on Thursday for questioning and later released on a personal bond, he said.

The SP also said the statements of the victims and their colleagues were recorded under section 164 of the CrPC.

Ballia (UP), May 29 : A 26 year-old married woman was held captive and allegedly raped by five persons in the district, police said.

According to the complaint lodged by the woman's husband yesterday, she was held hostage by five persons when she was on way to a market on May 13 and taken to an unknown place where she was gangraped, SP Sriparna Ganguli said today.

The woman managed to escape when the culprits were in an inebriated state and returned home, the SP said, adding that she has been sent for medical examination.

An FIR has been lodged and efforts on to nab the culprits, the SP added. PTI

Hamirpur, Apr 19: A 14-year-old girl returning from farms was gangraped by three men in Biwar area here late on Wednesday evening and her father was attacked with an axe when he resisted their attempt.
Deputy Superintendent of Police Abhishek Yadav here on Thursday said that three men, identified as Anand Kumar, Sanjay and Chandbabu, waylaid the girl when she was returning from agriculture field, and dragged her to secluded place where they raped her. 
Hearing the screams, when father of the victim girl tried to save her, the criminals attacked him with an axe and injured him severely. Both injured man and her daughter were shifted to hospital and medical examination report of the girl was awaited.
All three accused were arrested, the DSP said, adding that further actions would be taken after medical examination report of victim is received. UNI
