New Delhi, Jun 14  :  The Supreme Court Friday refused to entertain a plea which sought quashing of the answer keys of some questions in the NEET(UG)-2019 examination saying that an expert body has duly applied its mind and revised answers were issued.

The top court, however, allowed the four Hyderabad based students who have challenged the answer keys, to approach the high court for the relief.

It said that courts are not experts in each and every subject and time has come when the interference in this arena should be stopped.

A vacation bench of Justices Ajay Rastogi and Surya Kant allowed the four medical aspirants to withdraw their plea and granted them liberty to approach the high court with their grievances.

At the outset, senior advocate Abhishek Manu Singhvi, appearing for the students, said that wrong answer key were given by the National Testing Agency which conducted the exam on May 5.

He said the five questions having four marks each had more than one correct answers or had an answer which was different from answer key issued by the NTA.

"All multiple choice answers cannot be scrutinized by the this court. We are not experts. We think somewhere some line needs to be drawn," the bench said.

It said that interfering with the answer key would mean that Supreme Court has become an appellate body above the NTA.

The bench said that after the answer keys were issued to the questions asked in the May 5 examination, several students had made representation about the correct answers and subsequently revised answer key were issued.

"We see, an expert body has applied its mind and revised answer key was issued. In some cases, the answers were corrected. There does not seems to be a case of mala fide intent," it said.

Singhvi said that students career will be affected if the answers key were not corrected and suggested that an expert body should be constituted which shall look into the correct answer keys as the counselling is yet to start from June 19.

"Now a days, there is too much interference going on in this arena which is creating lot of problem," the bench said.

Counsel appearing for another set of students from Kolkata, who have filed a similar plea in Delhi High Court said that their petition was coming up for hearing on June 17.

He said that NTA has initially in its information voucher said that there will be only one answer to the questions in NEET examination but it was later found that a question had more than one answers.

To this, the bench told Singhvi said that it would be appropriate if they approach the high court with their grievances.

Yesterday, the apex court had agreed to hear a plea of medical aspirants, who claimed that the answer key of five questions asked in NEET(UG)-2019 exam was wrong and the paper needs to be quashed.

The petition filed by four Hyderabad-based students -- Kayathi Mohan Reddy and three others through advocate Mahfooz Nazki, said that National Testing Agency (NTA) which conducted the exam issued wrong answer keys and therefore jeopardised the career prospects of the aspirants who sat for the exam.

The exam was conducted on May 5 and the official answer key was issued on May 29 to the questions asked in the examination.

"Upon perusal of the key, the petitioners were shocked to note that answers to a number of questions were demonstrably wrong," the plea said.

The students said they gave the representation about the errors in the official answer key on May 30 and subsequently on June 5, a revised answer key was published.

"Pertinently, no option was given to the candidates to file any objections. To the shock and chagrin of the petitioners, not only did the key continue to have errors, some answers that had been correctly notified earlier, stood changed to a wrong answer," the petition said.

"...it is thus ex-facie evident that the whole exercise of examination conducted by the respondent no. 1 (NTA) is grossly illegal, arbitrary and impinges upon the constitutional and fundamental rights of the Petitioners herein and is vitiated in terms of the law laid down by this Court", it said.

The plea said, "The respondents have not only failed to rectify the defects/errors in the question papers but have also refused to accept any representations sought to be made by the petitioners in respect of the revised key. The whole process is, therefore vitiated and is liable to be set aside".                                                                 [Agencies]

New Delhi, Jul 25: Congress leader K C Venugopal today asked the government order an inquiry into the "serious issue" of leak of data of almost two lakh students who had appeared for the NEET exam this year.

Raising the issue during the Zero Hour in the Lok Sabha, Venugopal said the NEET (National Eligibility cum Entrance Test) data leak was a "serious issue of theft of personal data that has compromised the privacy of candidates across the country".

According to reports, personal data including names, phone numbers and email addresses, of over 2,00,000 candidates who appeared for the examination this year were available for a price on some online portals, he said.

The NEET was held on May 6 in 136 cities and conducted in 11 languages. The results were announced on June 4.

The incident also raises questions about the ability of the Central Board of Secondary Education to ensure the sanctity of the examination process, the Congress MP said.

"I would strongly demand that the government order an inquiry into the matter and take action against the people behind this crime.

"I would also request the government to take proper measuers to protect the privacy of the citizens of our country by taking strong measures to curb the data theft," he noted.

New Delhi, Jul 24: Congress president Rahul Gandhi has written a letter to the Central Board of Secondary Education (CBSE) over media reports claiming massive breach of data of candidates who appeared for the NEET examination this year.

He also demanded a thorough enquiry into the matter.

In the letter to CBSE chairperson Anita Karwal, Gandhi called for putting in place additional safeguards to prevent such a breach in the future.

The Congress leader's letter comes following reports that personal data, including names, phone numbers and email ids of over 2,00,000 candidates, who appeared for CBSE's National Eligibility and Entrance Test (NEET) this year were available for a price on some online portals.

I am shocked by this wide scale theft of personal data that has compromised the privacy of candidates across the country, Gandhi said in his letter.

He said it highlighted the serious lack of safeguards to prevent data breach, and calls into question the ability of the CBSE to ensure the sanctity of the examination process.

I strongly urge you to order an inquiry against this shocking lapse and take action against the officials responsible for the same. In addition, I request you to put additional safeguards to prevent the recurrence of such data breaches, Gandhi said in the letter.

Chennai, Jul 11: The CPI today welcomed the Madras High Court verdict directing the CBSE to grant 196 marks in the Tamil version of this year's NEET to those who took the exam for medical admissions in the regional language.

CPI State secretary R Mutharasan also urged the CBSE to implement the order.

"The State Committee of the CPI welcomes the High Court order," he said in a statement.

Referring to reports of the Central Board of Secondary Education (CBSE) mulling appealing against the order, he said this would amount to "confirming the social injustice meted out" to the medical aspirants.

He said CBSE should not do so and urged the board to implement the High Court order.

The Madurai bench of the Madras High Court had on Tuesday ordered the CBSE to grant 196 marks--4 marks each for 49 erroneous questions--in the Tamil version of this year's NEET to those who took the exam in the regional language.

Passing the orders on a public interest litigation, a division bench directed CBSE to consequently revise the list of eligible candidates and publish it afresh.

The petitioner, senior CPI-M leader and Rajya Sabha MP T K Rangarajan had sought full marks for the 49 questions, saying key words in Tamil questions were wrongly translated from English and this caused confusion for the students.

There were 180 questions with a total mark of 720 in the NEET.

The judges said the students who took the National Eligibility cum Entrance Test for admission to the medical and dental colleges in Tamil should be suitably compensated to provide a level-playing ground.

The CBSE conducted the NEET on May 6 in 136 cities in 11 languages, the results of which were announced on June 4.

In Tamil Nadu, about 1.07 lakh candidates took the test across 170 centres in 10 cities.

New Delhi, Jun 21 : The Supreme Court today refused to allow CBSE's appeal against a Bombay High Court order asking it to give proportionate marks to a batch of candidates, who lost 30 minutes due to the invigilator's fault during the NEET undergraduate exam 2018.

A vacation bench of justices S Abdul Nazeer and Indu Malhotra directed the Central Board of Secondary Education (CBSE) to comply with the high court's order within 10 days.

The board had yesterday moved the apex court against the validity of the June 15 high court order regarding the National Eligibility-cum-Entrance Test which was held on May 6 for admission to MBBS course.

The high court had directed the CBSE to apply the formula suggested by the apex court and award additional proportionate marks to 24 students who had appeared in examination at Nagpur in Maharashtra but were not allowed by the invigilator to write the exam for the stipulated three hours.

Petitioner Vaishnavi Sandeep Maniyar moved the high court claiming that the invigilator allowed them to write the exams from 10.30 AM only, instead of the scheduled 10 AM.

The apex court had in the CLAT (Common Law Admission Test) case directed for applying normalisation formula on the basis of answering capacity of the candidates, aspiring for admission to National Law Universities, and allot additional marks in view of technical glitches faced by them.

In the instant case, the high court had directed the CBSE to revise the marks of candidates, release corrected mark-sheet by June 22 and consider them for second round of counselling for admission to MBBS course. PTI

SRINAGAR, MAY 10: The Board of Professional Entrance Examinations (BOPEE) today made it clear that a transparent system of counselling has been adopted for allocation MD/MS/ PG Diploma seats to the candidates on the basis of the NEET score.
In a statement issued here today a spokesman of BOPEE said the Board has transformed the whole process of counselling which is visible from the fact that the first online list was notified just few hours after the judgement of the Division Bench on 01-05-2018. “Ordinarily, it would have taken two weeks together to prepare the list which is a cumbersome and tedious exercise,” it said adding that the candidates have been facilitated by way of sending them SMS/e-mails on different occasions reflecting the transparency prevalent in the Board
It said the Board shifted to offline counseling during second round due to internet issues which cropped up due to the prevailing circumstances for which provision is available in the NEET Brochure.
It said the process for physical round of counselling was elucidated in detail and the candidate has to be physically present at the time of availability of the seat.“During the upgradation round also on 07-05-2018 the seats were allotted purely on the basis of merit cum preferences and availability of the seats at the relevant point of time,” it said adding that even the candidates were given an option to upgrade in case a seat of their choice became available at a later point during the day of counselling considering the superior merit of the candidate, which ordinarily is not permitted.
According to the statement, the counselling of PGD Pathology ended at 8.32 pm when the seat was allotted to an available candidate at Jammu and no other candidate was available in Srinagar. The counselling forms reflect the time of allotment of the seats also to the candidates. Any candidate who had left the Board office and did not chose to participate in the process and wait for the seats which were duly reflected on the monitor available in the BOPEE Office cannot claim under any circumstances that his/her merit has been ignored. Such a candidate must have chosen to leave the Board office on his/her own choice. Board cannot go by whims and wishes of such candidates.
According to the statement, on 09-05-2018 some miscreants barged into the BOPEE office and damaged the cable wire to ensure that seats are not displayed. “But during the counselling the candidates were offered all the seats available. It is a concocted story that any seat has been hidden by the Board to favor any particular candidate, which is reflected from the seat matrix available,” it said adding that the seats which become available during the course of counselling on minute to minute basis are being reflected in the updated seat matrix on the monitor.
“The Board has serious reservation to the view that kith and kin of Board officials/officers are provided seats, which is ill conceived, mischievous and far from the truth and is only aimed at maligning the institution and erode its credibility,” it said adding that no candidate who is eligible to compete in the process can be stopped notwithstanding his/her relationship.
According to the statement some reserved category candidates had alleged that the category seats cannot be converted into open merit, which is far from the reality and the rules governing the allotment of seats. “Since the reservations to the medical colleges/institutions is governed by the State laws, which amply provide for filling up of unfilled category seats from the openmeritcategory,” it said adding that the Board has given sufficient time to eligible category candidates to avail the facility. Conversion of seats can take place even during first round of counselling if seats remain unfilled.
It said during the physical rounds also when a Committee of Officers comprising representatives from medical institutions and officers of the Board are available at Jammu and Srinagar for the counselling which takes place simultaneously through video conferencing. The allegations leveled that the physical counselling should have been done at one place only would only cause hardships and inconvenience to the candidates and their parents forcing them to move frequently from one region to other. During the physical round the merit position is maintained and the seats are displayed on minute to minute basis on the monitors available in the Board office.
Further any recruitment in service and admission to professional colleges are entirely two different things and are governed by different provisions of reservation act/rules, it said.

LEH, MAY 2: Deputy Commissioner (DC) Leh Avny Lavasa flagged off a group of 23 medical aspirant students including 18 girls and five boys for Jammu to give the NEET Medical entrance exam from Leh District Library yesterday.
The students are accompanied by Senior Librarian Lobzang Sushil.
Speaking on the occasion, DC said that the objective of this step is to give an opportunity to students with a poor financial background to appear in medical and other entrance exams held outside Ladakh. He added, the move also provides such students self-learning experience through exposure, long distance travelling, visiting new places and a better understanding of such exam patterns.
Addressing the students, DC urged upon students to make the best use of this opportunity by taking it seriously to gain maximum knowledge and experience.         She stressed that the experience will help them have a holistic approach to life and wished them best of luck.
DC also appreciated JD Education Tashi Dolma and Sr. Librarian Lobzang Sushil for having come up with the proposal of sending medical aspirant students to Jammu.

New Delhi, Mar 29: Describing the leakage of the Class 12 Economic board examination and the Class 10 Maths exam as a result of the ‘complete apathy’ and ‘deliberate negligence’ by the Ministry of Human Resource Development and the Central Board for Secondary Education, the Congress on Thursday demanded the sacking of HRD Minister Prakash Jawadekar and CBSE chairman Anita Karwal to fix accountability for the incidents.
Addressing a press conference here, AICC media incharge Randeep Surjewala, the Jt Secretary incharge for the NSUI Ruchi Gupta and AICC National Media panelist Ragini Nayak, said,’’the leak of the CBSE exams has exposed the capture of highest academic institutions by the ‘Exam Mafia’ under the watch of the Modi Government , as also absolute abdication of authority by HRD Minister Prakash Jawadekar and CBSE Chairperson Anita Karwal.
It is time to fix accountability and sack the HRD Minister and the CBSE chairperson..’’
Charging the Modi government of spreading the ‘Vyapam Virus’ across the country, Mr Surjewala said,’’first they nurtured the ‘Vyapam Virus’ in Madhya Pradesh, then they spread the same patented virus throughout the country in the multi layered SSC Scam and now they have not even spared our students. Encouraging ‘Exam Mafia’ has become the bedrock of BJP’s policies.
It is absolutely shocking and heart rendering that the future of 24 Lakh students is in severe jeopardy as the Modi Government officially admits that 2 CBSE papers- ‘Economics Examination Paper’ for Class XII leaked on March 26 and ‘Mathematics Examination Paper’ for Class X boards leaked on Wednesday, almost an hour before the students sat for the exam. ‘’
Describing report of leak of the two newspapers as “the tip of the iceberg”, Mr Surjewala said,’’It may just turn out to be the tip of the iceberg as multiple news reports and social media stories on how the Biology, Chemistry and English papers have also been leaked are also surfacing now. Despite registration of an FIR and an enquiry, shockingly; CBSE has admitted the leak of 3 exam papers.’’
Alleging multiple instances of bungling and malfeasance in the CBSE under the Modi Government, Mr Surjewala said,’’there were errors in the evaluation of Class XII board exam papers in the year 2017. Then there is the practice of inflating marks in board examinations.
Also notable is the alleged setting of tough questions in the NEET exam in regional languages. (MPs from Bengal and Tamil Nadu had complained about the nature of questions being asked to students taking the NEET in their mother tongue.) Coincidentally the officials in key positions at both SSC and CBSE are handpicked IAS officers of Prime Minister from the time he was Gujarat Chief Minister i.e Mr Ashim Khurana and Ms Anita Karwal. ‘’ UNI

New Delhi, Mar 29: Describing the alleged leakage of the CBSE class 10 and Class 12 board exams as ''unfortunate'', Union Minister for Human Resource Development Prakash Javadekar on Thursday said the Government has instituted an internal inquiry into the matter and the culprits will be punished.
Addressing reporters at a press conference to brief about the decisions of the Union Cabinet, Mr Javadekar  said,''it was an unfortunate incident. I can understand the frustration and the anger of the students and their parents.
''The CBSE has earned a name for itself for conducting examinations which is why it was chosen to conduct the NEET examinations. This (leakage) incident is a breach on the reputation of the CBSE and we will not allow the culprits to go scot-free. I am confident that the Delhi Police will nab the culprits just like it arrested four people in the leakage of the SSC exams.''
Mr Javadekar said the government had also instituted an internal inquiry into the alleged breach in the CBSE examination system.
''We have instituted an inquiry into the breach of the examination system. We must make all efforts to enure that the examinations go without any breach,'' he said.
He said the CBSE will decide on the next course of action, including the dates for the retest of the exams.
''We will take all steps to ensure that the system is foolproof. I want to assure all of you that the system will be improved and those guilty of the crime will be punished,'' he said.
The CBSE had on Wednesday announced a retest for the class 10 Maths Board exam and the class 12 board exam in Economics. UNI
