Jammu, Sept 20: While National Conference (NC) and Peoples’ Democratic Party (PDP) are using 35A to bycott the elections of Panchayats and Urban Local Bodies (ULBs), the Congress is trying to play with the emotions of the people of the state, Kashmir in particular, by assuring that if voted to power, nothing will happen to this Article of the Constitution. This is another evil attempt of the Congress to mislead the people just for the sake of getting votes, said BJP State Spokesperson Balbir Ram Rattan in a press handout.
How can the Congress state with such a certainty about the future of Article 35A when the case has yet to heard by the Supreme Court and give its final judgment? The statement of Congress President amounts to the contempt of the Apex Court, reads the handout.
Balbir Ram Rattan stated that Congress is the root cause of all the problems being faced by the state of Jammu & Kashmir, yet it is unwilling to accept the same and continues to mislead the people under the false belief that it can undo the past by playing with their emotions.
By making such a statement on 35A, Congress has betrayed the people of Jammu and Ladakh regions, who are against the continuation of 35A, Balbir said that when the same Congress says that the issue is within the powers of the State Legislature, it should first explain why this fact has dawn on this party now when it has been ruling the state for decades.
The Supreme Court had advised on a similar line while giving judgement on the case of Bachan Lal Kangotra versus State of Jammu & Kashmir, wherein the Court had hinted that “various local legislatures of J&K are discriminatory to West Pakistan Refugees (WPRs). J&K State Legislature to take action to amend various legislations to grant possible reliefs to the WPRs”.
Why has Congress failed to act on the advice of the Apex Court while in power, questioned the Spokesperson adding that the people of J&K are not gullible and they fully understand the game plan of the Congress and will teach it a lesson in the forthcoming elections.
Balbir also took serious note of the statement of the Congress party terming BJP as a communal party and reminded the Congress that it was the harbinger of communal and caste politics of India.

Jammu, Sept 06: National Conference (NC) has quitted the local bodies’ elections without contesting thus conceding defeat and accepting the reality that it has lost its mass base in all three regions of the state according to a press release issued by Bharatiya Janata Party. Former Chief Minister Farooq Abdullah on Saturday 02 September 2018, denounced militants and the separatist leadership for urging people to boycott polls and said they want to “keep pot boiling in Kashmir as they make fortunes out of people’s miseries.” Urging people to participate in the upcoming urban local bodies and Panchayat polls, Farooq said boycotting polls won’t help anybody. “It won’t resolve Kashmir issue and neither India nor Pakistan can benefit from it. It is for the betterment and development of people of the state.”
“Why same Farooq Abdullah has made a U-turn in 48 hrs and started singing the same tune as that of separatists and terrorists?Isn't he and his party also making fortune out of people's miseries?” questioned Brig Anil Gupta, State Spokesperson of BJP. Sensing imminent defeat in the forthcoming elections due to the poor response the party got in all three regions, NC has chosen the softer option of “quitting without contest” and resort to its tried and tested strategy of communal cum divisive politics by exploiting the regional and religious sentiments of the people of the state. The party has chosen Article 35A as an alibi only to distract the people from the reality of apparent ignominious defeat according to the press release.
The fact is that the feudal mind set of the party and its hereditary hierarchy are contradictory to the very concept of devolution of power to the grass roots level. Under the pretext of 35A, the Abdullahs want to save their own turf and fiefdom and retain their monopoly on control of funds received from the centre so that they can fill their coffers and of their cronies. “By boycotting the elections to the lowest echelons of grass roots democracy, NC has not only betrayed the people of Jammu & Kashmir but also its founding father Sheikh Mohammed Abdullah,” asserted Brig Gupta.
 “If NC is so concerned about the fate of Article 35A, why it did not boycott the elections to Ladakh Autonomous Hill Development Council Kargil? Why it did not oppose the local bodies’ elections at the very outset? What has forced the party to come on same page with terrorists and separatists? For how long the party can rely on opportunism without exposing its real face that is characterised by ‘duality’? These are a few questions the party needs to answer to the people since the party claims to be ‘voice of the people’ and true representative of all three regions of the state” demanded Brig Gupta.



Jammu, Sept 5: Reacting to National Conference leader Farooq Abdullah’s statement who on Wednesday said “his party will not participate in local body elections unless the Centre and the state government clears its position on Article 35 A and takes effective steps for its protection in and inside the court.” Former Deputy Chief Minister and MLA Gandhi Nagar said that it is not good on part of National Conference Leadership to correlate the issue of article 35 A, which is still Sub-judice, and the recently announced Local Bodies elections. The elections to these basic units of local administration are must for the development of the state. Every regional as well as National in the state should welcome the decision of state Government and come forward to participate in the electoral process. If these elections do not take place, then approximately Rs 4,400 crore financial grant would lapse in our state, he said. He urged all the main political parties of the state, not to play with the sentiments of the people of Jammu and Kashmir on pretext of Article 35 A. Gupta also criticised the role of Hurriyat Leaders and cautioned them to refrain from instigating people on the issue.



Jammu, Sept 5: NC is deliberately trying to change the narrative and mislead the people of the state by adding a new dimension of constitution of separate regional and sub-regional councils in order to divert their attention from all-important issue of legality of Article 35A of the Constitution of India stated Brig Anil Gupta, State Spokesperson of Bharatiya Janata Party in a press release issued by the Party today.  Having miserably failed in its propaganda to convince the people by creating a fear psychosis about the loss of identity and job opportunities in case of Article 35A being declared invalid by the Supreme Court, its leaders are now trying to confuse the people with the old  idea of regional councils stated the press release.
The idea of the regional and sub-regional councils is neither new nor the original idea of NC. While in power for so long the NC never ever gave any importance to this idea but all of a sudden has started championing its cause. It is basically aimed at diverting the emerging ground swell about repealing of Article 35A that is gaining momentum in different parts of the state accused Brig Gupta who further added by stating that the regional councils were no substitute for repealing unjust, illegal, divisive, anti-women, discriminatory and inhuman 35A. These councils do not enjoy any residuary powers without which the justice cannot be done to the aggrieved residents of this state.  The ensuing ULB and Panchayat elections have sent shivers down the spine of local NC leadership which had been playing a second fiddle to their Kashmiri bosses ignoring the people of LehLadakh and Jammu according to the spokesperson.
The party is once again trying to exploit the regional and sub-regional loyalties of the people by resorting to divisive politics based on region and religion blamed Brig Gupta. Questioning the NC leadership, Brig Gupta asked “Will the constitution of regional councils remove gender inequality and restore right of inheritance of the affected people? Will it grant the citizenship rights and associated privileges to the West Pakistan refugees? Will it remove the discrimination being faced by the Valmiki samaj, Bazigars and the Gurkhas? Will it supress or encourage separatism?” People of the state are not as gullible as the NC leadership thinks them to be and they would never fall prey to their deliberate manipulations, asserted Brig Gupta. 
“Was all this while the NC acting against the philosophy of Sheikh Mohammed Abdullah, who according to its leadership advocated empowerment at grass roots level, when it deliberately avoided the holding of elections to ULBs and Panchayats,” their leadership needs to explain to the people. The people are convinced that NC is a Kashmir-centric party and its local leadership is only shedding crocodile tears while their loyalties lie somewhere else. The declining graph of the party in successive elections is indicative of the determination of local people to never trust them again said Brig Gupta. “How a party that has repeatedly ditched the people of Jammu , stabbed them in their back and hurt Dogra pride can ever imagine to emerge as their voice again!” summed up the press release.



Srinagar, Aug 31: Life in Kashmir was disrupted for the second consecutive day today due to a complete shutdown called by separatists against the legal challenge in the Supreme Court on the validity of Article 35A, which bars people from outside Jammu and Kashmir from acquiring any immovable property in the state.

Restrictions imposed by authorities in some parts of the summer capital here as a precautionary measure for maintaining law and order remained in force for the second day, officials said.

Shops, business establishments and educational institutions were closed across the valley while transport remained off the roads due to the strike.

The Joint Resistance Leadership (JRL) had called for a two-day strike from yesterday as Supreme Court is scheduled to hear a PIL challenging the validity of the Article 35A today.

To maintain law and order, authorities continued with the restrictions in seven police station areas of the city here, the officials said.

They said the areas where restrictions under section 144 CrPC were in place include police station Khanyar, Nowhatta, Maharajgunj, Safakadal, Rainawari, Maisuma and Kralkhud.

The officials said security forces have been deployed in strength at vulnerable places in the city and elsewhere in Kashmir for maintaining law and order.

Various organisations including Bar Association, transporters and traders' bodies have extended support to the shutdown call of the JRL, comprising Syed Ali Shah Geelani, Mirwaiz Umar Farooq and Mohammad Yasin Malik.

Protests have been held across the length and breadth of Kashmir over the past month in support of continuing Article 35-A.

However, the officials said, the situation was peaceful so far across the valley.

The situation across the valley is peaceful with no untoward incident reported from anywhere so far, officials said.

Srinagar, Aug 27: Spontaneous shutdown was observed at several places in Kashmir after clashes broke out between youths and security forces following rumours about scrapping of Article 35A, a police official said.

Article 35A, which accords special rights and privileges to the citizens of Jammu and Kashmir, is facing a legal challenge in the Supreme Court.

"Spontaneous shutdown is being observed in many places in Srinagar, the summer capital of Jammu and Kashmir, and Anantnag district in south Kashmir," the official said.

He said announcements were made on loudspeakers that Article 35A has been scrapped and people were asked to observe a strike and come out to protest.

"Shops and other business establishments, which had opened this morning, downed shutters after rumours of Article 35A being scrapped spread like wild fire and were circulated on social media, the official said.

Stone-pelters clashed with security personnel in Anantnag and in the Safakadal area here in the wake of the rumours, he said.

The official said security forces are on the job to control the situation.

In a statement, police appealed to people to maintain calm and not pay heed to rumours.

"Some sections of media circulated news regarding Article 35A. The news is refuted as baseless. People are requested to maintain calm and not to pay heed to rumour. The main hearing is on August 31, the statement said.

Article 35A was incorporated in the Constitution by a 1954 Presidential Order.

Srinagar, Aug 25: A civil society group in Jammu and Kashmir today threatened mass agitation across the state if Article 35A of the Constitution, which is facing a legal challenge in the Supreme Court, was tinkered with.

The Jammu and Kashmir Civil Society Coordination Committee (JKCSCC), which claims to have members from all three regions of the state-- Jammu, Kashmir, Ladakh-- is an intervener in the case in the apex court.

The JKCSCC said if the constitutional provision which relates to the special rights and privileges of permanent residents of Jammu and Kashmir was removed, the relation of the state with the Union will be broken .

If anything is done to Article 35A, the relation with India will be broken there and then. If that happens, there will be a mass agitation," Muzaffar Shah, a member of the JKCSCC told reporters here at a joint press conference with other members of the civil society formation.

"We will come out on the roads right from Lakhanpur (the gateway to the state in Jammu region) to Leh (in Ladakh region of the state)... There will be bloodshed. Then peace will not be established, he added.

He, however, expressed hope that the SC would dismiss the petition filed by an NGO.

Suhail Kazmi a member of the group from Jammu said the constitutional provision was an issue of the identity and dignity of the people of the state and it was the duty of every citizen to safeguard it.

The people of Jammu region will bear the maximum impact if it goes away. We are with the people of Kashmir on this. The people of Jammu want Article 35A and Article 370 to remain intact, he said.

SRINAGAR, AUGUST 16: A delegation of PDP led by Sh. Abdul Rehman Veeri, former Minister, met Governor N.N. Vohra at the Raj Bhavan today.
The delegation expressed concerns relating to the legal challenge to the Article 35-A of the Indian Constitution; raised issues relating to the security concerns of their Party members arising from threat of attacks on its leaders and workers; up - gradation of schools and creation of new colleges as decided by the outgoing government; engaging unemployed youth who had been given training in the tourism and floriculture sectors; need for conservation of Dal and Wullar Lakes; and allowing ERA to also handle World Bank aided projects.
The delegation thanked Governor on his decision to hold the long overdue elections to the Urban Local Bodies and Panchayats.
Governor urged the PDP delegation to raise awareness about the vital importance of the forthcoming elections to empower people and establish urban and rural self- governing democratic bodies.

BJP demands inquiry on killing of youth at former CM’s residence
Jammu, Aug 09: Stressing that the political relationship of J&K with the rest of India is set through “Instrument of Accession” only, BJP tells that Constitutionally and legally, nothing can save 35-A.
This was stated in a Press Conference held at party headquarter by BJP Chief State Spokesperson Sunil Sethi along with BJP State Press Secretary & State Media Incharge Dr. Pardeep Mahotra. Where as he also raises certain questions on the killing of youth at former CM’s residence.
Sunil Sethi attacked on deliberate mis campaign by disproportionally extra vocal entities. NC’s allegation that the relation of state with rest of India will be bothered, if 35-A ceases to exist and similar statements being issued by PDP and other Kashmir based fringe groups like those of Hurriyat Conference are blatant lie.
Sethi stressed that only “Instrument of Accession” defines political relationship of the state with Nation. Article 1 very clearly defines that J&K is just like any other state of India. Section 3 defines it as an integral part of India. J&K is an integral part of Nation and 35-A or 370 doesn’t define relationship of state with Nation, Sethi said.
Sethi said that in 1953, government of former CM Sheikh Abdullah rather promised the people displaced from western Pakistan that they will be given rights and were immediately provided lands so that they don’t leave the state. This issue was raised in 1954 as the result of political and diplomatic failure of former Prime Minister Pt. Nehru. In the aftermath of those blunders, Presidential order was issued without consent from Parliament of India, he said.
Constitutionally and legally, nothing can save 35-A, Sethi said. Supreme Court will conduct an impartial hearing and the result will be out. Kashmiri politicians understand this fact and so are ill-motivating people.
Sethi demanded an impartial probe be done by SIT headed by senior IPS officer for the unwanted firing incident at the residence of former Chief Minister Farooq Abdullah, in which a young man died. The FIR of the family should be entered. An unarmed person with no crime history enters the house of former CM, why? If he had intensions to harm somebody, he could have some arms with him. How he entered the house? How he could shatter the things inside with presence of so much security. Why the forces didn’t only fire at the feet or legs? Why there was no CCTv Camera on the back door? Responsibility should be fixed and the questions need to be entered, he said and added that BJP asks for a fair enquiry into the matter.

Jammu, Aug 08: The Congress party has made it very clear that entire unit of J&K Pradesh Congress Committee (JKPCC) is unitedly supporting the retention of Article 35A. In other words retention of 35A is the national policy of Congress which was clarified in a telephonic chat with anchor of one of the prominent TV channels by the Chief Spokesperson of Congress. When questioned by the anchor about division on the issue amongst the Jammu based leaders of Congress, the Chief Spokesperson vehemently denied any such difference in opinion and confirmed that entire Party stood solidly behind the demand of retention of article 35A. Thus, the Congress party has admitted that it had been merely playing vote bank politics with West Pakistan refugees, Gorkhas, Valmiki Samaj and the daughters of the soil every time on the eve of elections by promising  grant of their rights to them, stated Brig Anil Gupta, State Spokesperson of Bharatiya Janata Party. “There are enough remedies available to meet the aspirations of the affected people without tinkering with Article 35A but the leadership of Kashmir centric parties, who have been ruling the state, have never been sincere about addressing their genuine grievances because their entire politics revolves around the Kashmiri-speaking Muslims,” blamed Brig Gupta.
These political parties want to play politics in name of Article 35A through emotional exploitation of the people and create polarisation in the state on the basis of notorious Dixon Plan, warned Brig Gupta. Article 9 of the Constitution of J&K permits changing the definition of Permanent Citizen if needed. However, no government so far has availed the remedy provided by the Constitution to resolve the citizenship issue of West Pakistan refugees (WPR), Gurkhas, Valmiki Samaj, questioned Brig Gupta. It is the lack of intent and not lack of mechanics available to address the issue.
“While Maharaja Hari Singh's Farman aimed at protecting the rights of his subjects, what has been the intention of Kashmiri leadership right from Sheikh Abdullah? If Article 9 can be revoked to grant permanent citizenship to Tibetan Muslim refugees, why the same cannot be done in respect of Hindu refugees of Jammu region? It obviously is to protect state's Muslim majority character? And these parties call themselves as Secular and dub BJP as communal?
What an irony?Secularism means equal opportunities for all. It means inclusivity and not exclusivity,” rued Brig Gupta.
Similarly, in the case of Bachan Lal Kalgotra, Supreme Court of India had advised the J&K government in its judgement in 1987 to meet the justifiable grievances of WPR by amending legislatures such as J&K Representation of Peoples Act, the Land Alienation Act, the Village Panchayat Act, without having to amend state’s constitution or touching Article 35A. But none of the governments thereafter ever paid any heed to the advice of the Supreme Court because they were not interested in resolving the issue but keep it alive for vote bank politics and polarisation, as and when needed, accused Brig Gupta.
“As far as gender inequality is concerned, despite the favourable judgement in SushilaSawhney case, it is highly condemnable that both NC and PDP attempted to misuse the provision of Article 9 by introducing bill in the assembly titled Women (Disqualification) Bill to deny to the women their just rights. Fortunately the Bills did not see the light of the day,” said Brig Gupta. He further added that even now the hullabaloo created by these parties is aimed at disturbing the fragile peace in the Valley that has emerged after imposition of Governor’s Rule.

Srinagar, Aug 21 : Asserting that people of state, irrespective of their political beliefs and regional affiliations, are unanimous in protecting Article 35-A, the Jammu and Kashmir Civil Society asked government to call a special session of Legislature to discuss measures to build consensus on the issue.
Main opposition National Conference (NC) and other political parties in Kashmir, have already urged the coalition PDP-BJP government to call special session of the Legislature to discuss the issue.
However, the civil society members, including senior lawyers and members of state Bar Association, said that they are not satisfied with affidavit submitted by the state government in the Supreme Court (SC) in response to the PIL, seeking abrogation of Article 35-A.
“The state government is showing lackadaisical attitude in defending the Article 35-A before the SC, which is a cause of concern at all levels. The affidavit submitted by the state government in the SC in response to the PIL, seeking abrogation of Article 35-A, is not satisfactory, but very weak,” Civil Society member Advocate G N Shaheen told reporters during a press conference here today.
He said the special status of the state should be protected till Kashmir issue is resolved in accordance with the aspirations of the people of the state.
“We the people of J&K irrespective of political beliefs, religions, denominations, geographical destinations and ethnic classifications are united in defence of the protection of Article 35-A and Article 370 till the final settlement of Kashmir dispute. We can’t afford the luxury of ignorance and neglect, deceit and deception in scraping the special protections guaranteed in terms of Article 35A ore Article 370,” he added.
“The various sections of the society especially the civil society members are raising their voices in defence of Article 35-A and against its abrogation though public protests, seminars, symposiums in a peaceful and democratic way but the gravity and seriousness with which the matter deserves to be attended at political and legal level is lacking,” he said.
He said delegations of Civil Society members will meet leaders of mainstream political parties, separatists and businessmen in all three regions of the state to united them against attempts being made to abrogate Article 35-A.
“We also want the people to be ready to defend Article 35-A tooth and nail if the need arises,” he added.
Meanwhile, All Parties Sikh Coordination Committee (APSCC) chairman Jagmohan Singh Raina said the minority community, as always, will fight for the protection of Article 35-A alongside with their Muslim, Hindu and Dogra brethrens.
“I don’t understand the need for raising issues like abrogation of Article 35-A when the valley is already going through tough times. The entire Sikh community, be it from Jammu or Kashmir, will fight to protect Article 35-A,” Mr Raina said.
Another Civil Society member Muzaffar Shah said the attempts to abrogate Article 35-A has united people of the state, irrespective of their political beliefs and regional affiliations. “We should thank the people who filed PIL against Article 35-A as it is because of this the people from all three regions, mainstream political parties and separatists have been united to fight a common cause,” Mr Shah said.
“Article 370 and Article 35-A is according a special status and constitutional protections to the state of J&K. Since its inception there has been gradual erosion of the Article 370, and attempts to abrogation of Article 35-A is the last nail in its coffin. The present NDA government is using judiciary to promote its political agenda to the satisfaction of Sang Parivar,” Adv Shaheen said.
He said since the matter is pending before the apex court, therefore it is incumbent upon all to prepare a solid defence and seek dismissal of PIL, seeking abrogation of Article 35-A. “If need arises, we shall ask all concerned expert hands in the constitutional matters and international law,” he added.UNI


Srinagar, Aug 18 :  National Conference Working President Omar Abdullah today sought a special session of Jammu and Kashmir Legislature before August 29 to frame up an appropriate response to counter the narrative with regard to tampering or repealing of Article 35A of the Constitution.
      The Supreme Court (SC) is likely to hear all petitions that demand scrapping of the articles should be heard together on August 29.
      “The issue is of vital importance for the people of Jammu, Kashmir and Ladakh, as abrogation of Article 35A will have serious ramifications,” Mr Abdullah, who is also the former chief minister of the state, said here today.
      Mr Abdullah expressed grave concern over the reported unsatisfactory response of the Union and the State governments in putting up a strong case before the apex court in safeguard of the Article 35A.
      “The observation of the Centre’s attorney that the issue needs wider discussions has created apprehension in the public mind about intentions of the BJP led NDA Government,” he added.
      “And, in such a precarious situation, the State Legislature will have to take a call on this fundamental issue, especially as the Constitution empowers the Legislative Assembly to determine the issues with regard to permanent residence,” Mr Abdullah said while appreciating general consensus across the state, irrespective of caste, creed, religion or region, with regard to preserving of this significant constitutional guarantee bestowed upon Jammu and Kashmir by Constitution of India.
      “It is therefore appropriate to have the aspirations of the people reflected through the State Legislature,” he said.
      The NC Working President hoped that the people of Jammu and Kashmir will rise above party politics and fight every overt or covert attempts to trample with Article 35A, which is regional neutral, religious neutral and ethnic neutral.
      He said abrogation of this proviso is detrimental to every segment of society in Jammu and Kashmir.UNI

Srinagar, Aug 18 :  Former Union Minister and senior Bharatiya Janata Party (BJP) leader Yashwant Sinha today said that the Centre should immediately clear it's stand on Article 35-A of the Constitution, which grants special status to the residents of Jammu and Kashmir. Meanwhile, four state ministers led by Finance Minister Haseeb Drabu will go to New Delhi today to garner support of the BJP top brass, besides seeking legal support of the central government to defend Article 35-A in the Supreme Court (SC), which has accepted to head a plea questioning the validity of the article. “People of Jammu and Kashmir are very concerned over the issue and the Centre should clear it's stand,” Mr Sinha, who is here on a three-day visit since August 16 told mediapersons. He said the Jammu and Kashmir government has already filed a reply against the petition challenging the Article in the Supreme Court . “Now it is the duty of the Centre to make it's stand clear on the issue as people are very concerned here,” he said. Mr Sinha, who heads Delhi based Concerned Citizens Group (CCG), had met former chief ministers and opposition National Conference (NC) president and working president Dr Farooq Abdullah and Mr Omar Abdullah here and discussed the overall political situation in Kashmir valley yesterday. “Our meetings are the continuation of peace mission that we had started last year,” Mr Sinha told reporters after meeting Abdullahs. He said that the meeting with Mr Abdullah lasted for an hour in which the prevailing situation was discussed. “We also discussed what the policy and attitude of the government should be for peace in the state,” the senior BJP leader said. “We have again come here on peace mission and would meet people of different shades to have first hand information of the situation in the Valley,” he said. Referring to Prime Minister Narendra Modi’s Independence Day speech in which he said that "bullets and abuses won’t solve Kashmir problem", he said it has given a hope that things would change for better now. Srinagar, Aug 14 : Train service remained suspended for the third day today for security reasons in south Kashmir, while no train will chug in north Kashmir. All train runs between Badgam-Srinagar in the central Kashmir to Anantnag-Qazigund in south to Banihal in Jammu region remained suspended for the third day, a senior railway official told UNI this morning. No train will run on this route, he said adding this decision was taken after a fresh advisory was received from authorities and police last night. Train service will be resumed only after receiving green signal from the authorities. He also said train service between Srinagar-Badgam in central Kashmir to Baramulla in north Kashmir has also been suspended for security reasons. Train service was suspended on August 12 in the Kashmir valley for security reasons following strike called by both the factions of the Hurriyat Conference (HC) and Jammu and Kashmir Liberation Front (JKLF), spearheading the agitation, demanding right to self determination in protest against alleged attempts to abrogate Article 35-A of the constitution. However, it was resumed on Srinagar-Baramulla track yesterday. During the past about two months train service has been suspended frequently for security reasons in the valley, where train property had suffered damage due to demonstration. Last year train service remained suspended for about six months due to summer unrest in the valley. However, daily travelers are the most affected due to suspension of train service which is now being considered most trusted, cheap and fast. UNI
