New Delhi, Jun 21 :  The government on Friday introduced the fresh triple talaq bill in the Lok Sabha amid vehement protests by opposition members who claimed that it was violative of the Constitution

The Muslim Women (Protection of Rights on Marriage) Bill 2019 became the first legislation to be tabled in Parliament by the Narendra Modi dispensation in its second term, with Law Minister Ravi Shankar Prasad asserting the legislation was a must for gender equality and justice

The bill was introduced following a division of votes, with 186 members supporting and 74 opposing it

"This is not a question of religion but about justice to women," Prasad said

Seeking to justify the need to bring in the legislation, Prasad said there were 543 cases of triple talaq reported in the country. After the Supreme Court judgement banning triple talaq practise, Prasad said more than 200 cases were reported

"This is a question of dignity of women and we are committed to (safeguard) it," he said

He said the job of Parliament was to legislate and it was up to courts to interpret the law

As soon as Speaker Om Birla asked Prasad to move the bill, several opposition members rose in protest and Birla allowed them to put forth their point of view

Shashi Tharoor of the Congress said he was opposed to triple talaq (instant divorce) but was against this bill as it conflates civil and criminal laws

He claimed it was a textbook example of class legislation as it was pointed at one community -- Muslims-- even though abandoning wives is not unique to it

Tharoor said there should be a law universally applicable to all in case of abandoning wives

Asaduddin Owaisi of the AIMIM took a dig at the BJP, saying it has so much affection for Muslim women but is opposed to rights of Hindu women to enter Sabrimala Temple in Kerala

The triple talaq bill violates constitutional rights as it stipulates three-year jail term for guilty Muslim men while non-Muslim men get only one year of jail term for a similar offence, he said

N K Premchandran of the RSP also opposed the bill

With the dissolution of the 16th Lok Sabha last month, the previous bill had lapsed as it was pending in the Rajya Sabha

The Bill, which proposes to make the practice of instant triple talaq (talaq-e-biddat) a penal offence, had faced objections from opposition parties from the beginning which claimed that jail term for a man for divorcing his wife was legally untenable

The new bill is a copy of the ordinance in force. Bills that are introduced in the Rajya Sabha and are pending there do not lapse with the dissolution of the Lok Sabha.

However, bills passed by the Lok Sabha and pending in the Rajya Sabha lapse with the dissolution of the lower house

The government had promulgated the ordinance on triple talaq twice -- in September 2018 and in February 2019 -- as the contentious bill remained pending in the Rajya Sabha, though it was passed by the Lok Sabha

As per the bill, divorcing through instant triple talaq is illegal, void and will attract a jail term of three years for the husband

Seeking to allay fears that the proposed law could be misused, the government has included certain safeguards in it such as adding a provision for bail for the accused during trial

These amendments were cleared by the Cabinet on August 29, 2018

While giving triple talaq is a "non-bailable" offence as per the bill, an accused can approach a magistrate even before trial to seek bail

In a non-bailable offence, bail cannot be granted by police at the police station itself. A provision was added to allow the magistrate to grant bail "after hearing the wife".                       [Agencies]

New Delhi, June 12 :  The Union Cabinet on Wednesday cleared a fresh bill to ban the practice of instant triple talaq, Environment Minister Prakash Javadekar said.


The bill will replace an ordinance issued in February by the previous BJP-led NDA government.

The fresh will be introduced in the budget session of Parliament, beginning Monday, Javadekar said.            [Agencies]

New Delhi, Feb 19 :   The Union Cabinet Tuesday gave its nod to re-issue the contentious Triple Talaq ordinance that makes the practice of instant triple talaq by Muslim men a penal offence.

The Cabinet has given its nod to the Triple Talaq ordinance, Finance Minister Arun Jaitley told reporters in the Cabinet briefing, noting that it is among those ordinances and bills which had been passed by the Lok Sabha but could not be taken up in the Rajya Sabha due to continuous protests by opposition parties. 

Once signed by President Ram Nath Kovind, the triple talaq ordinance will come into force for the third time in less than one year.

A bill on the ordinance making the practise of 'talaq-e-biddat' (instance divorce) void and an offence is pending in Rajya Sabha. The bill will lapse on June 3 with the dissolution of the present Lok Sabha. 

Opposition parties and some community leaders have claimed that jail term for a man for divorcing his wife is legally untenable. The government has asserted that it provides justice and equality to Muslim women.

To a question about the need for a government to clear several ordinances, including the one on triple talaq, weeks ahead of the general election, Jaitley said discussions on these ordinances and bills had been "physically prevented" in Parliament. 

"It (discussion) has not been prevented because numbers were against it... Indian democracy cannot be helpless. Extraordinary situations do call for such steps," he said, adding that some ordinances, including one against inter-state ponzi scheme, are in a larger national interest. 

The government has promulgated the ordinance on triple talaq twice. 

Under the Muslim Women (Protection of Rights on Marriage) Ordinance, 2019, divorcing through instant triple talaq will be illegal, void and would attract a jail term of three years for the husband 

A Bill to convert the earlier ordinance, issued in September, 2018, was cleared by the Lok Sabha in December and was pending in the Rajya Sabha 

Since the Bill could not get parliamentary approval, a fresh ordinance was issued. 

Seeking to allay fears that the proposed law could be misused, the government has included certain safeguards in it such as adding a provision of bail for the accused before trial. 

These amendments were cleared by the Cabinet on August 29, 2018. While the ordinance makes it a "non-bailable" offence, an accused can approach a magistrate even before trial to seek bail. 

In a non-bailable offence, bail cannot be granted by police at the police station itself. 

A provision has been added to allow the magistrate to grant bail "after hearing the wife", the government had said.                                                   [Agencies]

New Delhi, Sep 19: The Union cabinet is learnt to have cleared an ordinance to make the practice of instant triple talaq a penal offence, Law Ministry sources said Wednesday.

The 'Muslim Women Protection of Rights on Marriage Bill' was cleared by the Lok Sabha and is pending in the Rajya Sabha where the government lacks numbers.

The Supreme Court last year banned the practice. But since the practice was still prevalent, a bill was brought to make it a penal offence. (PTI)

Banda (UP), July 9: A woman has complained to police that she was given triple talaq and forced to leave her husband's house because the roti she had prepared got burnt.

The incident had happened in Pahretha village of Mahoba district and it came to light after the 24-year-old woman registered a complaint with the police yesterday, ASP Banshraj Yadav said.

On the basis of her complaint, a case of domestic violence will be registered the husband, he said.

The woman, who got married last year, also alleged that her husband had inflicted burn injuries on her with cigarettes three days before 'divorcing' her by way of triple talaq, the police said.

The Supreme Court had on August 22 last year struck down triple talaq, calling the practice unconstitutional and in violation of Article 14 of the Constitution, which provides for equality before the law. (PTI)

Aurangabad, Mahrashtra, Mar 24: Thousands of Muslim women held a rally here on Friday protesting against the Centre's Triple Talaq Bill.
As per the order issued by the Muslim Personal Law Board, the morcha was taken out from AamKhas Maidan to Divisional Commissioner Office in a disciplined manner.
Organising Committee Convenor said the Act was against the provision of right of freedom of expression and religion enshrined in the Indian Constitution and accused the central government of polarising Muslim community.
It was also alleged that the Act was drafted without taking the Muslim Community in confidence.
They said if the bill got passed through the Rajya Sabha, Muslim women could not live with dignity and would have no
freedom.
Some speakers said they wanted to live as per the Muslim Personal Law and the government should not interfere into the matter.
Later, a memorandum was submitted to the Divisional Commissioner. Their main demands were to delete the Para on the Muslim Women from Presidents address to the Parliament, to advise the Central and State Governments not to hurt the sentiments of the second largest community of the country and as it was a defective bill, the bill should be forwarded to Select Committee. UNI

I am glad I fought for injustice of Triple Talaq against women that has always been exploited by Muslim men. Now, there is some dignity that women can enjoy.'
Sunaina Kumari, who was earlier president-Indian Lawn Bowls Federation, was also felicitated by Mr Choudhary.
'It was a big challenge to be the only woman in the Indian Olympic Association,' Sunaina said.
She, too is a rare achiever, who was successful in breaking the glass ceiling.
'There is nothing that women cannot do or achieve. With a little bit of support, we can do anything,” she said.
The event featured performances by well-known singers Angad Singh Ranyal, Tanya Nambiar and Prateek Kuhaad.
Besides many Bollywood celebrities, including Tisca Chopra, Manoj Bajpayee, Rannvijay Singh, Tapsee Pannu and others, endorsing the initiative and recording a one-minute video in support of the movement, the 'BeGood Philosophy' was also launched, after which Appreciation Awards were given away.
The thought behind such a unique initiative was to collectively seek to make 'goodness' a way of life. Since within every human being lies the potential for goodness, and a desire to be a force of positive change, there is an urgent need to put aside the negatives vibes that may manifest from any corner, and urge others to do 'the right thing'. Hyderabad, Feb 10: All India Muslim Personal Law Board (AIMPLB) General secretary Moulana Wali Rehamani said on Saturday that the issue of instant Triple Talaq was a threat to the Muslim personal law. 
In his detailed report at the 26th plenary session of AIMPLB, Moulana expressed concern over the threat to the personal law with the instant triple talaq issue.
The report appreciated the stand of opposition parties in Rajya Sabha, where the bill was stalled. He urged the Personal Law Board to suggest and guide the Muslims and asked the plenary to evolve a strategy to stop the Union Government move for passing the bill. 
In his report, Moulana Rahmani said the Central government wanted to interfere in the personal law matters which were guaranteed in the Indian Constitution. 
Regarding the contentious Babri Masjid issue, he said that the Apex court was of the view that the case was related to the title of the land and did not relate to the matter of faith or belief. 
He further said that the related documents had already been submitted, there were some documents which were yet to be translated, as per the court observation. 
Without naming anybody he said that misleading rumors were circulated, stating some elements were trying to misguide the people on Babri Masjid issue. 
He reiterated that the Personal Law Board stand was that "one’s a Masjid always Masjid". He said that "we are ready for negotiations, that should based on fair justice and equal honor". UNI

New Delhi, Feb 6: BJP on Monday attacked Congress and Opposition for doing politics over the Triple Talaq Bill.
Amid protest by TDP and YSR Congress MPs over demand of special status to Andhra Pradesh, BJP MP Rakesh Singh initiated a debate in the Lok Sabha on the Motion of thanks to the President’s address to both Houses of Parliament on January 29.
Initiating the debate, the BJP member said the Union Government has brought a Bill to declare instant Triple Talaq illegal but the Congress and Opposition are doing politics over it.
He said the Union Government brought Ujjwala scheme which aims to provide cooking gas to poor households. 
Mr Singh said the Government has increased the period of maternity leave from 14 weeks to 21 weeks.
He said the Government has taken steps to increase the farmer's income and the Government is committed to doubling of farmers’ income by 2022. The BJP member also made a reference to Soil Health Card scheme.
The BJP member said the present Government brought Pradhan Mantri Jan Dhan Yojana which aims to link poor people with the banking system.
He welcomed President Ram Nath Kovind stressing the need for a sustained debate on the issue of simultaneous elections to the Lok Sabha and various state assemblies during his address on January 29.
The BJP member said elections held at different time adversely affects the economy and development. UNI

Gonda, Jan 6: A woman alleged that her husband left her by giving her talaq over phone from Mumbai to get rid of their specially challenged daughter.
Police sources said here on Saturday that Mubaraq Ali, a native of Chadauva village, had married with Shakina Bano of Balhari village 17 years ago. Presently, Mubaraq lives in Mumbai and his wife was staying at her father’s house with their specially challenged daughter Karishma.
Shakina alleged that when she asked for the money for her 14-year-old daughter’s treatment, Mubaraq gave her talaq on phone from Mumbai on November 14.
Police has registered a case against Mubaraq on complaint of Shakina and started investigations. UNI

New Delhi, Jan 3: Notwithstanding the fact that the Triple Talaq Bill has been stalled in Rajya Sabha as Congress members insisted to refer it to a Select Committee, the government on Wednesday said it would still push for it during the two remaining days of the winter session of Parliament. 
"The Congress party's double standard stands exposed....They could not stall it in
Lok Sabha because we have numbers. Now they are doing it in Rajya Sabha,"
Union Law Minister Ravi Shankar Prasad told reporters here shortly after the Rajya
Sabha was adjourned.
The government sources said it will try to push the Bill during two last days of winter
session.
Close on the heels Rajya Sabha proceedings were adjourned for the day
without taking up the Triple Talaq Bill, the Union Minister accused the Congress party
of indulging in "double standards" and for delaying 'justice' to Muslim women.
"I am sorry to say ....it is a delaying tactics," he said.
"I regret that Congress has taken different stands in Lok Sabha and
Rajya Sabha. It is their delaying tactic," he said.
He said there was hardly any justification that the Congress party is now opposing the

"The larger issue is the political hypocrisy of the Congress.

order, several Muslim women were still falling 'victims' of Triple Talaq especially in
Uttar Pradesh.
However, Congress leaders Kapil Sibal and Ranjeet Ranjan justified Congress stance
in the Upper House saying the issues raised by Congress party on the Bill needs
adequate deliberations.
"Even in Lok Sabha, we said the bill should be debated properly," Lok Sabha MP
Ms Ranjeet Ranjan said adding, "We are supporting the bill in both Lok Sabha

New Delhi, Jan 03: The Triple Talaq Bill was on Wednesday introduced in the Rajya Sabha amid the ruckus by the Opposition, which demanded that the Bill be referred to a Select Committee of the Upper House.
The Muslim Women (Protection of Rights on Marriages) Bill , 2017 was introduced in the House by Law Minister Ravi Shankar Prasad even as the Opposition members were raising an uproar on the Dalit violence in Maharashtra.
The Opposition member, however, raised an uproar, demanding that the Bill be referred to the Selection Committee of the Upper House.
On the Opposition demand to send it to the select committee, the Law Minister said the Bill has been necessitated after Supreme Court directed the government to frame a law to make talaq-e-biddat illegal.
'The Supreme Court gave its order in August declaring the instant triple talaq as illegal. It, however, urged the Government to come out with a legislation within six months.
'If this Bill is sent to Select Committee now, it will take another six months for it to be passed. We have to consider the plea of several Muslim. Triple talaq is continuing despite the Supreme Court banning it. This Bill is necessary. I appeal to the Congress to support the Bill,' he said amid disruptions by Opposition MPs. UNI

New Delhi, Jan 2: The Sharad Pawar-led NCP on Tuesday suggested that the much talked about Triple Talaq Bill be sent to the Select Committee of the Rajya Sabha as it was "brought in hurry".
"Heaven will not fall.......," NCP MP Majeed Memon told TV channels. "These are sensitive matters, we should not repent in future," he said.
He said the government seemed to have brought the Muslim Women (Protection of Rights on Marriage) Bill, 2017 in hurry."Why they did not consult all stake holders...why this was done secretly," he said.

New Delhi, Dec 28: The Triple Talaq Bill introduced in the Lok Sabha on Thursday proposes a law that renders 'void and illegal' any pronouncement of instantaneous talaq by a person either by ‘’spoken words or in electronic form’’, which includes phone call, SMS and e-mail.
Government, while stating the Objects and Reasons to bring in the Bill, said it was done after it was found that instant triple talaq was taking place in spite of the Supreme Court order of August 22, 2017 setting aside the practice of talaq-e-biddat(three pronouncements of talaq at one and the same time).
'This judgement gave a boost to liberate Indian Muslim women from the age-old practice capricious and whimsical method of divorce, by some Muslim men, leaving no room for reconciliation,' it said.
Therefore, in order to prevent the continued harassment of Muslim women, an urgent suitable legislation was required, the Government said.
The legislation would help to ensure the larger Constitutional goals of gender justice and gender equality of married Muslim women and help subserve their fundamental rights of non-discrimination and empowerment, the Government said. 
The proposed law provides for punishment with jail term which may extend to three years and fine, and makes the offence cognisable and non-bailable.
It also entitles a victim of talaq to receive an amount subsistence allowance for her and dependent children as determined by a magistrate and stipulates that the woman would also be entitled to custody of her minor children in the event of pronouncement of talaq by her husband.
The Bill says that ‘’talaq’’ means talaq-e-biddat or any other similar talaq having the effect of instantaneous and irrevocable divorce pronounced by a Muslim husband.
It also says that ‘’electronic form’’ shall have the same meaning as assigned to it in the clause(r) of the sub-section(l) of section 2 of the Information Technology Act, 2000. UNI

New Delhi, Dec 28: The controversial bill to make triple talaq a cognisable and non-
bailable offence and provide for jail up to three years for the offenders was on Thursday 
introduced in the Lok Sabha by the Government amidst vehement protest by the Opposition 
parties.
However, Law Minister Ravi Shankar Prasad, while introducing The Muslim Women (Protection of Rights on Marriage) Bill, said this legislation was not of any religion but about dignity and justice for women. 
'Today is a historic day,' he said amidst thumping of desk by Treasury benches and protests from the Opposition benches.
Replying back to the opponents of the Bill, he said,'if the instantaneous talaq was continuing
even after the Supreme Court judgement rendering the triple talaq or talaq-e-bidat as illegal, can this House remain silent?'
'Today the House has to decide whether Muslim women victims have any fundamental rights,' Mr Prasad said and asserted that Parliament had full rights to make a law to secure justice to its citizens.
Earlier, as Mr Prasad moved to introduce the Bill, several members belonging to the All India 
Majlis-e-Ittehadul-Muslimeen(AIMIM), the Indian Union Muslim League, the BJD and AIADMK objected to the legislation describing it as legally flawed and against the basic structure of the Constitution.
Asaduddin Owaisi of AIMIM said if the Bill was passed, it would be injustice to Muslim women. He also said Parliament lacked legal competence and there had been no consultation with stakeholders in the drafting the bill. UNI

Bhopal, Aug 22 :  Madhya Pradesh Chief Minister Shivraj Singh Chouhan today welcomed the Supreme Court’s decision declaring the contentious issue of ‘triple talaq’ as unconstitutional. In a social media post soon after the judgement, Mr Chouhan urged the Centre to frame a legislation vis-à-vis ‘triple talaq’ at the earliest. He said that practices such as ‘triple talaq’ tantamount to social and mental harassment of women and are impediments in the country’s development. Lucknow, Aug 22 :  All India Muslim Personal Law Board (AIMPLB), one of the parties in the Triple Talaq issue in the Supreme Court, today welcomed the judgement upholding the fundamental rights of the Muslims by declaring the law as unconstitutional. AIMPLB would be meeting in Bhopal on September 10 to discuss on the SC ruling on Triple Talaq and the new format of Nikahnama to prevent it. On the judgement of the five judges bench of the top court, senior counsel and member of AIMPLB Zafar Ayeb Jilani told reporters, "We are happy that the court has declared triple talaq as ultra vires..." Lauding the judgement, he said it has enhanced respect of the people for the judiciary, besides strengthening secularism, democracy and rule of law. He announced that AIMPLB would now go for hectic campaigning to bring down the malice of triple talaq through social reforms. "We would propose to include Triple talaq in one sitting and it could be included in the Nikahnama, while the Quazi, who solomonises nikahs, would be asked to make people aware that talaq in one sitting is Gunah (crime) in Islam," he added. New Delhi , Aug 22 : The Supreme Court, by majority judgement, today declared the practice of triple talaq in one go as unconstitutional. The judgement was delivered by a five-judge bench headed by Chief Justice of India JS Khehar and comprising Justices R F Nariman, U U Lalit and Kurian Joseph and Abdul Nazir. The three judges (Mr Nariman, Mr Lalit and Mr Joseph) said that the triple talaq was unconstitutional and un-Islamic. However, the two judges (Mr Nazeer and Mr Kehar) gave a dissenting judgement. The apex court decision came on a bunch of petitions challenging the practice of triple talaq. UNI
