New Delhi, Jun 23 :  Seeking to give more teeth to the National Investigation Agency (NIA), the government plans to amend two laws to allow it to probe terrorist acts against Indians and Indian interests abroad.

The Union cabinet will take a call on Monday on amending the NIA Act and the Unlawful Activities (Prevention) Act.
The amendment bill could be introduced in Parliament this week during the ongoing Monsoon session.

The amendments will also allow the NIA probe cybercrimes and cases of human trafficking, sources aware of the proposal said Sunday.

Amendment to Schedule 4 of the UAPA will allow the NIA to designate an individual suspected to have terror links as a terrorist. As of now, only organisations are designated as 'terrorist organisations'.

The NIA was set up in 2009 in the wake of the Mumbai terror attack that had claimed 166 lives.

Since 2017, the Union Home Ministry has been considering the two laws to give more power to the NIA to meet fresh challenges, the sources pointed out.                                            [Agencies]

Mumbai, Sep 3: The Bombay High Court raised questions Monday over Maharashtra police's media briefing on its case against some prominent activists arrested for their alleged links with Maoists.

State Additional Director General (Law and Order) Parambir Singh along with the Pune police had addressed the media on the case on Friday.

During the press conference, Singh had read out letters purportedly exchanged between the activists. He claimed that the police had "conclusive proof" to link Left-wing activists arrested in June and last week to Maoists.

A division bench of Justices S S Shinde and Mridula Bhatkar questioned how the police could read out such documents which may be used as evidence in the case.

"How can the police do this? The matter is sub judice. The Supreme Court is seized of the matter. In such cases, revealing information pertaining to the case is wrong," Justice Bhatkar said.

Public prosecutor Deepak Thakare said he would speak to the police officials concerned and seek their response.

The bench was hearing a petition filed on Friday by one Satish Gaikwad, who claims to be a victim of the Koregaon Bhima violence. He sought a probe by the National Investigation Agency (NIA) in the case.

Gaikwad urged the high court to restrain the Pune police from further probing the case, and stay the investigation.

The bench posted the petition for further hearing on September 7.

Gaikwad in his petition also alleged that the Pune police were investigating the case unfairly and with malafide intentions.

"It is unfortunate that the Pune police have arrested intellectual persons of society, who are social rights activists, advocates, human rights activists, poets, writers and other respectable persons," he said in the petition.

Since provisions of the Unlawful Activities (Prevention) Act have been invoked in the case, it would be appropriate for the NIA to probe it, the petitioner said.

Police had arrested activists Sudhir Dhawale, Rona Wilson, Surendra Gadling, Shoma Sen and Mahesh Raut in June while probing the alleged Maoist connection with the Elgar Parishad conclave held in Pune on December 31 last year.

Inflammatory speeches at the event led to violence at Koregaon Bhima near Pune on the next day, police had alleged.

Last Tuesday, police arrested five more Left-wing activists -- Vernon Gonsalves, Arun Ferreira, Varavara Rao, Sudha Bharadwaj and Gautam Navalakha -- from different places in the country.

The Supreme Court later ordered that the five be kept under house arrest till September 6.

Srinagar, Aug 30: The National Investigation Agency (NIA) today arrested Syed Shakeel Yousuf, son of globally wanted terrorist Syed Salahuddin, in connection with a 2011 terror funding case for allegedly receiving money from his father.

An NIA spokesman said in Delhi that Shakeel, at present working as a laboratory assistant at a prestigious government hospital, was picked up from Rambagh locality of Srinagar and placed under arrest.

The spokesman said, "In an operation today morning, NIA team along with the police and CRPF arrested Shakeel in a terror funding case".

He is the second son of Salahuddin who has been arrested by the NIA in connection with the case. Earlier in June this year, his another son, Shahid, who was working in the agricultural department of the Jammu and Kashmir government, was arrested in the same case.

The NIA alleged Shakeel used to receive funds through a US-based international wire transfer company from Aijaz Ahmed Bhat, another accused in the case who is absconding and based in Saudi Arabia

The agency alleged Shakeel was "one of several Indian contacts of Bhat" who had been in telephonic contact with him for receiving money transfer codes

The case, registered by the NIA in April 2011, relates to transfer of money from Pakistan to Jammu and Kashmir through hawala channels via Delhi, which the agency believed was used in funding terrorism and secessionist activities

The NIA has so far filed two charge sheets against six people including G M Bhat, a close aide of pro-Pakistan separatist Syed Ali Shah Geelani, Mohammed Siddiq Ganai, Ghulam Jeelani Liloo and Farooq Ahmed Dagga. All four are in judicial custody

Two others -- Mohammed Maqbool Pandit and Bhat -- were also charge sheeted by the NIA but are absconding. An Interpol Red Corner notice has been issued against them

Shakeel's father Mohammed Yusuf Shah -- better known as Syed Salahuddin -- was declared a Specially Designated Global Terrorist by the US Department of State.

Besides heading terror outfit Hizbul Mujahideen, he is the chairman of the United Jehad Council (UJC), a conglomerate of terrorist outfits operating in the Kashmir Valley.

The NIA had also registered two others cases related to terror funding -- one in November 2011 and the other in May this year.

The agency had filed a charge sheet against 10 people including Syed Salahuddin in the April 2011 case.

In the recent case, the NIA arrested 10 people including some close relatives and aides of Geelani.

Jammu, Aug 29: A special court here today sent Deputy Superintendent of Amphalla Jail Feroz Ahmed Lone, who was arrested by the NIA in an alleged terror conspiracy case, to nine days police remand.

He was produced before NIA Special Judge Haq Nawaz by the agency today.

The judge said the application moved was "genuine" and remanded the accused to police custody for nine days.

"I heard and perused the file as an application for the remand. The prayer made by the NIA seems to be genuine and as such, the present application is allowed," he said.

Feroz Lone was arrested by the National Investigation Agency here yesterday for allegedly conniving with the main accused, Ishaq Palla, to send Kashmiri youths Suhail Ahmad Bhat and Danish Ghulam Lone to Pakistan-occupied Kashmir for arms training to wage war against India.

A meeting in this regard took place on October 25, 2017, at the Central jail, Srinagar, where Feroz Lone, a resident of Budgam, was then posted as Deputy Jail Superintendent, the NIA said.

"Palla, a resident of Shopian, was lodged in the Srinagar jail in a different case and he was instrumental in hatching the conspiracy from there. He was actively assisted by Feroz Lone," alleged the agency.

"The case pertains to an attempt by Bhat and Danish Lone, who were arrested earlier, to travel to PoK for arms training to wage war against the state. They were motivated by Palla," the NIA said.

Bhat and Danish Lone were arrested by Jammu and Kashmir Police in Kupwara district near the Line of Control while trying to cross over to PoK on October 30, 2017. They were reportedly going to join the militant outfit, Hizbul Mujahideen.

The NIA said the duo was in constant touch with each other through the blackberry messenger during the entire month of October before being apprehended.

Palla, arrested along with Feroz Lone, was yesterday remanded to 10 days' NIA custody by the special court.

Srinagar, Jul 7 :
Authorities imposed restrictions in parts of Kashmir today as a precautionary measure to maintain law and order on the eve of the second death anniversary of Hizbul Mujahideen commander Burhan Wani, even as a strike called by separatists evoked mixed response in the Valley.

Restrictions have been imposed in Tral township, in south Kashmir's Pulwama district, and in the Nowhatta and Maisuma police station areas of Srinagar the summer capital of Jammu and Kashmir, a police official said.

He said the curbs have been imposed as a precautionary measure to maintain law and order and to avoid any untoward incident.

Wani, a resident of Tral, was killed in an encounter with security forces in the Kokernag area of south Kashmir's Anantnag district on July 8, 2016.

His killing triggered massive protests and prolonged period of curfews and shutdowns across the Valley. As many as 85 people were killed and thousand others were injured in clashes between security forces and protesters over four months.

The official said security forces have been deployed in strength at sensitive places across the Valley.

Meanwhile, the strike called by separatists against the shifting of Asiya Andrabi, the chief of radical women's outfit Dukhtaran-e-Millat (DeM), to Delhi by the National Investigation Agency (NIA), evoked mixed response in the Valley today.

The separatists, under the banner of Joint Resistance Leadership (JRL), had yesterday called for a strike to protest the shifting of Andrabi and her colleagues.

The JRL comprising Syed Ali Shah Geelani, Mirwaiz Umar Farooq and Yasin Malik appealed to the people to "observe a complete shutdown and maintain civil curfew".

While shops and other establishments were shut in the city centre Lal Chowk here, business continued as usual in other areas of the city, the official said.

He said public transport was sparse, but private cars, cabs and auto-rickshaws were plying in many areas of the city.

The official said similar reports of a mixed response to the strike were received from other district headquarters of the Valley.

Cracking a whip on separatist leaders ahead of Wani's death anniversary, the police had yesterday detained Malik in a police station here, while Mirwaiz was put under house arrest. Geelani continued to remain under house detention.PTI

Hyderabad, Apr 19: The High Court of Judicature at Hyderabad has rejected the resignation of Special National Investigation Agency (NIA) Court Judge K Ravinder Reddy, who had put in his papers hours after he acquitted five accused in the 2007 Mecca Masjid Bomb Blast case which claimed nine lives and 58 others left injured.
High Court Acting Chief Justice Ramesh Ranganathan not only declined his resignation but also cancelled the 15-day leave the judge had sought.
The acting Chief Justice asked the Judge to report to work immediately.
Justice Reddy, the Fourth Additional Metropolitan Sessions Judge, had put in his papers on April 16 soon after he delivered the verdict in the Mecca Masjid bomb blast case in which he acquitted all the accused, including Swami Assemanand.
In a letter to the Metropolitan Sessions Judge and the acting Chief justice of the High Court, Justice Reddy stunned everyone by resigning on the day he delivered the verdict in the 11-year-old case, citing 'personal' reasons.
All India Majlis-e-Ittehadul Muslimeen president Asaduddin Owaisi, who had blamed the NIA for failing to properly prosecute the accused, had said, 'Justice Reddy’s decision was intriguing. and I am surprised with the Lordship decision"
Nine people were killed and 58 were injured on May 18, 2007, after an improvised explosive device ripped through the mosque during Friday prayers.
Hyderabad Police had carried out the initial inquiry before handing over the case to the Central Bureau of Investigation, which filed a charge sheet against 10 accused – all members of right-wing groups. In 2011, the National Investigation Agency took over the probe.
Only five of the 10 people were arrested and faced trial. They are Devendra Gupta, Lokesh Sharma, Aseemanand alias Naba Kumar Sarkar, Bharat Mohanlal Rateshwar alias Bharat Bhai and Rajendra Chowdhary. One of the accused – Rashtriya Swayamsevak Sangh leader Sunil Joshi was murdered in December 2007 while former RSS member Sandeep V Dange and RSS activist Ramchandra Kalsangra are absconding. Authorities are still investigating the cases against Parmar and Amith Chowhan. UNI

New Delhi, Apr 16: Commenting on acquittal of all accused in Mecca Masjid blast case, the National Investigation Agency (NIA) on Monday said the probe agency will study the judgment before deciding the future course of action.

A blast had occurred in historic Mecca Masjid in Hyderabad in Friday prayer meeting, leaving nine dead and 58 injured on May 18, 2007.
The Central Bureau of Investigation (CBI) took over the case from the local police and filed charge sheet in 2011.
Subsequently, the NIA took over the case from the CBI in 2011.

New Delhi, Mar 24: The Ernakulam NIA Court on Saturday awarded seven years rigorous imprisonment to Yashmeen Mohammad Zahid, an accused in ISIS Kasaragod case.
The Court has also imposed a fine of Rs 25,000.
She was charged under sections 120 B, read with 125 of IPC besides sections 38, 39 and 40 of the Unlawful Activities (Prevention) Act.
The accused, a native of Sitamarhi district of Bihar along with her husband Abdul Rashid Abdulla, a principal accused and absconder in this case, was involved in activities intended at supporting the terrorist organization and helped fourteen persons from Kasaragod district in Kerala who, along with their families, had exited India between May and July, 2016 and joined the Islamic State of Iraq and Syria (ISIS) or Daesh.
"National Investigation Agency (NIA) investigation revealed that the main accused Abdul Rashid Abdulla had recruited the other accused persons in this case including Yasmeen Mohammed Zahid by conducting classes at Kasaragod and other places in 2015 for terrorist organization ISIS and its ideology of violent jihad", an NIA official release said here.
He had motivated his co-conspirators including Yasmeen Mohammed Zahid to join the terrorist organization waging war against Asiatic Powers at peace with the Government of India.
Yasmeen Mohammed Zahid was intercepted at New Delhi International Airport on July 30, 2016 while she was exiting India for Kabul with the intention of joining her husband Abdul Rashid in the ISIS controlled territory in Nangarhar province of Afghanistan, which the accused persons consider as part of the Khorasan Wilayat of the Islamic State.

Yasmeen had got acquainted with Abdul Rashid Abdulla while working in Peace International School at Kottakkal in Malappuram district, Kerala and they had later got married secretly.

New Delhi, Mar23: The Supreme Court on Friday asked the Karnataka, Goa and Maharashtra governments to file detailed affidavits within four weeks in the MM Kalburgi murder case.
Author MM Kalburgi was allegedly murdered in Dharwad in Karnataka in 2015.
A three-judge bench of the apex court, headed by Chief Justice of India (CJI) Dipak Misra and also comprising Justices AM Khanwilkar and DY Chandrachud was hearing the submissions from Krishna Kumar, lawyer appearing for Umadevi Kalburgi, wife of the deceased author, MM Kalburgi.
Umadevi Kalburgi had moved the apex court seeking a Special Investigation Team (SIT) probe into the murder of her husband MM Kalburgi.
Umadevi, in her petition, had alleged that the same organisation's shooters were allegedly involved behind the murders of her husband MM Kalburgi, Pansare and Dabholkar. She said the Karnataka Police probe was in a sorry state.
Kalburgi's widow had in the last hearing, in January, told the top court that it seemed that there was a similar pattern in the alleged murders of her husband, Dhabolkar and Panasare and there has to be a coordinated probe into all the three cases.
Additional Solicitor General (ASG) Pinky Anand, senior law officer representing the central government, told the CJI bench that the NIA (National Investigating Agency) was a specialised agency to investigate national and inter-state terrorism cases and was prohibited by the NIA Act to probe into murder cases.
The case may come up for hearing again after four weeks. UNI

Kohima, Mar 22: Former chief minister and Opposition Leader T R Zeliang has termed media reports claiming to have confirmation of documentary evidence indicating his involvement in terror funding case as nothing but “pure exaggeration and dim-witted imagination at its heights.”
In a communiqué issued by information & publicity wing of leader of opposition’s office on Wednesday asserted that distorting facts did not change the story and added that linking Zeliang to terror funding by some reporters buttressing their stories with fake inputs claiming to have been obtained from National Investigation Agency (NIA) and government sources was highly objectionable and put journalism ethics to shame.
The communiqué clarified that news reports appearing in Assam and Nagaland media or anywhere else and linking the former chief minister to terror funding were neither confirmed by NIA nor by Zeliang or his office, but were mere copy-paste from reports published on hearsay. It rebutted the news published in a national daily by stating that it was totally wrong and misleading. Zeliang had personally written for deferment of the date for his cross examination because of the Assembly session, which would end on March 2, and there was no written reply to NIA through any advocate at any point of time, it was further clarified.
Asserting that some “political virus” with vested interests trying to flare up the issue could not be ruled out, leader of opposition’s office stressed that NIA would never provide such false information to any media house or reporters and the recent fake reports in the media was nothing but a remake of allegations raised against Zeliang in 2015 when he was accused of laundering Rs 78 Crore in Singapore and Hongkong banks. The general public had believed the false news till it was confirmed from the banks concerned, the office pointed out. Alleging that such news reports were the brainchild of people with destructive mindset, the communiqué called for avoiding false news reports and publishing unconfirmed news reports without authentication at all cost.
The leader of opposition’s office said it was constrained to issue the clarification to put speculations related to NIA summon of Zeliang to rest and set the record straight for all times. UNI

Singh submitted to the apex court that the probe is almost complete.

The top court said this in connection with the Kerala love Jihad case.
A three-judge bench of the apex court, headed by Chief Justice of India (CJI) Dipak Misra and also comprising Justices AM Khanwilkar and DY Chandrachud, said, "when two adults got married, can a court interfere into it?"
The top court has deferred the matter for further hearing to March 8, Thursday.
Senior Supreme Court lawyer, Shyam Diwan, counsel appearing for Hadiya's father, Ashokan, argued before the top court three-judge bench that the Kerala High Court was right in exercising its jurisdiction as it was not a normal marriage. "The girl seemed to be under the influence of an extremist organisation. It seemed that this issue was an issue of mass trafficking. She was a vulnerable adult," he said.
Divan also submitted to the top court that the National Investigating Agency (NIA) also should be heard by the apex court as to what investigation it had carried out so far on the lines of human trafficking.
Kerala Love Jihad case victim, Hadiya (also known as Akhila) had on February 20, filed an affidavit in the Supreme Court and stated that she was a Muslim and wanted to remain as a Muslim. Hadiya, in her affidavit, also stated that she wanted to remain as wife of Safin Jahan.

New Delhi, Feb 13: Considering the new dimension of terror attacks in hinterland through proxy war by Pakistan, the National Investigation Agency (NIA) has slapped Weapons of Mass Destruction and Delivery System (Prohibition of Unlawful Activities) Act in Bodh Gaya terror attack case which took place on January 19. This is the first occasion where the WMD Act has been invoked by a probe agency in India in a terror related case.
The NIA took over the investigation into the case from Bihar Police following a directive from the Union Home Ministry on February 3.
On the basis of prima facie suspicion, the Probe agency has imposed some section of WMD after the recovery of Improvised Explosive Device (IED) was made of materials falling under the category of weapons of mass destruction, though the exact nature or the category of the material will be determined once the forensic analysis test reports are available, an agency source said. “The material in question could be a chemical toxin intended for mass killing”, added the source.
Sections 14, 17 and 19 of the Weapons of Mass Destruction and Delivery System (Prohibition of Unlawful Activities) Act, 2005 have been applied in this case, according to the FIR.
The Act is aimed at prosecuting persons accused of unlawful activities relating to weapons of mass destruction and their delivery systems including those nuclear, chemical toxin and bacteriological (biological) materials. The Act provides for a minimum punishment of five year to life imprisonment along with monetary fine.
The NIA has also slapped Section 16, 18 and 20 of the anti-terror law Unlawful Activities (Prevention) Act, provisions of the Indian Penal Code relating to conspiracy, waging war against the nation and promoting enmity between groups besides the Explosive Substances Act.
The Act came into force in 2005 as part of integrated legal measures to exercise controls over the export of materials, equipment and technologies and to prohibit unlawful activities in relation to weapons of mass destruction and their means of delivery.
The Bihar Police had registered the case on January 20 this year at Bodh Gaya police station relating to recovery and explosion of IED on January 19 near 'Kalachakra Maidan' and other places.
The explosive was hidden in a Milton flask containing gelatin stick and detonators. Incidentally, the attack was carried out at a time when Tibetan spiritual leader Dalai Lama was there in the temple town to address thousands of devotees from around the world at the shrine as part of a Buddhist festivity there. Two more IEDs were found in the temple vicinity.
The sources said the IED recovered from the shrine’s south gate which was packed in an unusual large flask and is suspected to contain the WMD material. The NIA is likely to take custody of two Jamaat-ul-Mujahideen, Bangladesh operatives arrested by the Anti-Terrorist Squad ofthe Bihar police from Kolkata in connection with the case. UNI
