Jammu, Oct 04: The deportation of seven (7) Rohingyas from Assam to their native country of Myanmar is indeed a step which will have far reaching impact in the border state of Jammu & Kashmir, Jammu province in particular, which houses the population of illegal immigrants from neighbouring countries. The state unit of Bharatiya Janata Party views this development as positive and progressive.
This was stated by BJP State Spokesperson Balbir Ram Rattan, while terming the move as right decision in the right direction, although belated due to the vote bank  policy of the earlier governments of Congress and NC, who played key role in getting the settlement of illegal immigrants of foreign citizens from Burma, Bangladesh and Myanmar in different pockets of Jammu. These people have acquired identity cards, got registered as voters and even possess Aadhar Card.
The BJP had been spearheading the movement for their identification and deportation from Jammu to countries of their origin since long. The party had also sensitized the Union Home Ministry and made several representations to the central leadership for their early deportation. In this regard, a petition was also filled before High Court by one of the member of BJP Legal Cell in 2015.
There had been instances when these people were under scanner for involvement in anti-national activities. There had been apprehension that the settlement of these illegal immigrants in Jammu was a part of conspiracy to change the demography of Jammu and also serve as mean of boarding / guiding elements working against interests of the nation.
Balbir said that the Union Home Ministry has taken few important measures to set in motion the process of the deportation of illegal immigrants and the latest step in this regards is the direction to all states to carry out biometric identification of all such people settled across the country.
He said that the BJP urges upon the Governor’s administration to set in motion this process in Jammu Kashmir  on priority since Rohingyas are also a security threat in the region adding that the party condemns the role of Congress, whose senior leaders were involved in facilitating their settlement in Jammu and currently some of these are contesting their deportation in Supreme Court.

New Delhi, Sep 26: The Aadhaar Act could not have been passed as Money Bill as it amounts to a fraud on the Constitution and is liable to be struck down, Supreme Court Justice D Y Chandrachud said Wednesday.

Justice Chandrachud, who was part of the five-judge Constitution bench headed by Chief Justice Dipak Misra, wrote a separate judgement saying he had expressed some views different from that of the verdict pronounced by Justice A K Sikri.

Bypassing the Rajya Sabha to pass the Aadhaar Act amounted to subterfuge and the law was liable to be struck down as being violative of Article 110 of the Constitution, he ruled.

Article 110 has specific grounds for Money Bill and the Aadhaar law went beyond this, Justice Chandrachud said, adding that in the current form, the Act cannot be held to be constitutional.

He observed that the enactment of the Act does not save the Centre's Aadhaar scheme.

Noting that mobile phone has become an important feature of life and its seeding with Aadhaar posed a grave threat to privacy, liberty, autonomy, he favoured deletion of consumers' Aadhaar data by the mobile service providers.

Maintaining that the Prevention of Money Laundering Act Rules proceeded on assumption that every bank account holder is a money launderer, he said the assumption that every individual who opens a bank account is a potential terrorist or a launderer is "draconian", he said.

Justice Chandrachud also said collection of data may lead to individual profiling of citizens.

He said the Aadhaar programme violated informational privacy, self-determination and data protection. It has been admitted by UIDAI that it stores vital data which is violative of right to privacy, he added.

This data was vulnerable to be misused by third party and private vendors, and that too, without the consent of an individual, Justice Chandrachud maintained and said the Aadhaar project has failed to remedy the flaws in its design, leading to exclusion.

Allowing private players to use Aadhaar will lead to profiling, which could be used to ascertain the political views of citizens, the judge, who pronounced his separate verdict, said.

He also held that denial of social welfare measures was violation of fundamental rights of citizens.

There is no institutional responsibility of the UIDAI to protect the data of citizens, he said, adding that there was absence of a regulatory mechanism to provide robust data protection.

However, he said it was now impossible to live in India without Aadhaar but it was violative of Article 14.

If Aadhaar is seeded with every database, then there is chance of infringement of right to privacy, he said.

Justice Chandrachud said while Parliament possesses the right to make a law, the absence of protection leads to violation of various rights.

New Delhi, Sep 26: The Trinamool Congress Wednesday hailed the Supreme Court judgement which struck down Section 57 of the Aadhaar Act which allowed corporate entities to access its data.

The Supreme Court has declared the Centre's flagship Aadhaar scheme constitutionally valid.

"SC strikes down section 57 of Aadhaar Act, 2016. So you don't need to give your Aadhaar to private bodies like banks, schools, mobile companies. Trinamool and @mamataofficial fought hard for this," the party said in a tweet.

The apex court's five-judge Constitution bench headed by Chief Justice Dipak Misra said Aadhaar is meant to help benefits reach marginalised sections of the society and takes into account the dignity of people not only from the personal but also from the community point of view.

The top court said Aadhaar is serving a bigger public interest. Aadhaar means unique and it is better to be unique than be the best, it said.

New Delhi, Sep 5: The Unique Identification Authority of India (UIDAI) has asserted that schools cannot refuse admission to students for lack of Aadhaar, and termed denial on such grounds as "invalid".

It has also exhorted schools to co-ordinate with local banks, post offices, state education department and district administration, to facilitate special camps in their premises for Aadhaar enrolment and updation.

According to an official circular addressed to the Chief Secretaries of States, the UIDAI has said that it is aware of instances where some schools are refusing admission in absence of Aadhaar.

"It must be ensured that no children are deprived/denied of their due benefits or rights for want of Aadhaar," said the circular seen by.

Warning that such denials are "invalid and not permitted under the law", the Aadhaar-issuing body has said that "no child should be denied admission and other facilities for lack of Aadhaar".

The move by UIDAI is expected to come as a major relief to parents and students who have been facing difficulties due to schools insisting on Aadhaar number during admission.

"Till Aadhaar number is assigned or biometrics are updated for such students all facilities should be extended through alternate means of identification...," UIDAI has said.

Jaipur, Aug 18: The government must slap penalty on anyone using Aadhaar data for purposes other than public services, whistle-blower Edward Snowden has said.

Addressing an event via video-conference, he said that if Indian government was serious about implementing Aadhaar for public good, it must ensure "criminal penalty" against anyone misusing the data.

Mass surveillance system would look like Aadhaar as it creates systemisation of society, he told the fifth edition of 'Talk Journalism' event organised here last weekend.

Systemisation of society is something that is not stated in the scheme of things for the Unique Identification Authority of India (UIDAI), he added.

Replying to a question the surveillance issue, he said that no government will say that it has decided that "you don't have rights". They would rather say that they are bringing in a new programme that will safeguard people's rights and protect them.

Snowden said that it's a myth that youngsters are not concerned about privacy. Youngsters are very much concerned about their privacy, he added.

He made a point stating that citizens don't need to explain why they need privacy it's the government that needs to explain why people don't need rights.

The former USA secret agency CIA employee said that "we have privacy issues" because it helps those who violate it. He said that privacy can be safeguarded through better encryption systems and strong legal system.

New Delhi, Aug 11: Aadhaar cards of over 30,000 children living in child care institutions have been linked to the Track Child portal in a bid to bolster the information base on the number of children under institutional care amid reports of children going missing from shelter homes, an official said.

Track Child functions as a central database of all those children who have gone missing in different parts of the country. The portal will aid coordination between child homes, police departments and state governments.

The government is linking Aadhaar card with the children in child care institutions to bolster the information base on the number of children under institutional care and a total of 30835 Aadhaar card numbers have been linked till now, according to a Women and Child Development official.

There are a total of 261566 children living in over 9000 CCIs across the country.

According to the official, Aadhaar enrolment procedure by child care institutions at times have led authorities to finding parents of the child as during enrolment it was found that children already had an Aadhaar card which had their address.

The aim of linking the Aadhaar to Track Child is also helping in finding the child who had gone missing from child care institutions as if the child is tried to enrolled somewhere his whereabouts would become known.

"The Ministry has asked all the stakeholders to ensure Aadhaar registration of children in all CCIs. Necessary action is been taken by the state governments as reported by them at various platforms. There is already a provision of entering Aadhaar details of a child on the TrackChild Portal," the official said.

The details come amid reports of children going missing from child care institutions. About 18 girls were recently reported missing from a shelter home in Deoria where reports of alleged sexual harassment of girls surfaced.

As reported by National Crime Record Bureau (NCRB), a total of 68,874, 60,443, and 63,407 children were reported missing during the year 2014, 2015 and 2016 respectively.

New Delhi, Apr 5: The Supreme Court on Thursday disputed the Centre's contention that Aadhaar was the panacea for all ills in the system, including bank frauds.
A five-judge Constitution bench, headed by Chief Justice of India (CJI) Dipak Misra held, Aadhaar was not a solution.
It observed, 'Hundreds of crores of rupees bank frauds were allegedly done in connivance with bank officials by alleged fraudsters. How is Aadhaar secure? The lender knows whom it is giving loan and it is the bank officials who are hand-in-glove with the fraudsters. Aadhaar can do little to stop it.'
Justices Arjan Kumar Sikri, Ashok Bhushan, DY Chandrachud and A M Khanwilkar were also on the bench which heard arguments and submissions from petitioners and respondents.
Multiple appeals had been filed before the apex court challenging the constitutional validity of Aadhaar and the Centre's making it mandatory to link the 12-digit unique identification number with bank accounts, mobile phones and others.
Attorney General K K Venugopal, representing the Central government, submitted to the bench that adequate security measures had been adopted to ensure that data was not leaked out in any form from collection centers.
Through Aadhaar, the AG said, the Union of India was providing food, shelter and employment to those who lived on the fringes and Government had taken precautions that right to privacy was affected at the most minimal way.
The Supreme Court had ruled those downtrodden who need food and shelter also had a right to privacy which could not be violated by the state. UNI

Kohima, Mar 22: The Naga Students’ Federation (NSF) met Nagaland Chief Minister Neiphiu Rio and apprised him of several concerns on behalf of the student community.
A release issued by NSF informed that the Federation submitted a representation to the chief minister to highlight issues which are pending or are yet to be taken up by the government. One of the issues included delay in the distribution of free school uniforms and textbooks. The NSF informed that in almost all the schools there were serious delay in distribution of these items.
Regarding the Mid Day Meal scheme, the NSF stated some schools have not provided the meals even once for the previous academic session. “We are amazed to discover precisely a contradictory scenario and the schemes never reached the grassroots for whom the project was intended for,” the NSF stated. The students’ body alleged that the amount sanctioned for the scheme “were siphoned off by some unscrupulous elements.” It demanded that disciplinary measures be initiated to penalize those responsible. In this regard, the NSF urged the Nagaland CM to expedite the investigation process being undertaken by the State Vigilance Commission through a Case for investigation into irregularities and mismanagement of Mid Day Meal Scheme.
Another issue the NSF highlighted was the School Education departmental examination. It reminded the CM that the federation had appealed for selection of indigenous inhabitant applicants of the state on priority with regard to the exam held on September 2017. It stated the then School Education Minister had replied for consideration of only eligible applicants of the indigenous inhabitants of the State. The NSF however lamented that as per the results “it appeared that candidates selected were against the aspiration and voice of the student community.” It therefore demanded that the selection of non-indigenous inhabitant applicants of the state be nullified and the waiting list of merit indigenous inhabitant applicants be considered for selection to the vacant posts. The NSF also expressed concern that despite written assurance given by the Government to disburse the total amount of post metric scholarship, there are still around 12,000 students yet to receive their due shares for the year 2016-2017.
It asked the CM to take necessary action so as to enable for payment of the pending scholarship at the earliest.
The NSF meanwhile highlighted other issues not solely concerning students. One such was the Inner Line Permit (ILP). The NSF pointed to the influx of non-locals and illegal immigrants into the state and the lack of stringent implementation of the Bengal Eastern Frontier Regulation (BERF) Act of 1873. The provisions of BERF Act 1873 are too old and many of its provisions are irrelevant in our present context, the NSF stated. Having aired their concerns to the Chief Secretary in October 2017, the federation lamented that there has not been any response on the issue yet. The NSF also took the opportunity to express concern at the Aadhaar Card/UID being made compulsory. “The NSF considers the imposition of Aadhaar card/UID number as a big threat to Naga customary law and identity. It is nothing but a direct challenge of privacy threatening even the idea of Nagas right to self-determination. Imposing of such drastic nationalising policy upon the Nagas pending the final Indo-Naga solution is thus inimical to the process of Indo-Naga Peace Dialogue,” it stated. UNI

New Delhi, Feb 23: A Dynamic Identification System(DID) , that aims to improve upon the existing technology devised by the UIDAI for 'Aadhar' , has been developed by an Army officer and Security Technologist.
Named as ‘Chanakya Chakra’ , the DID, developed by former Army officer Col (Retd.) Sanjeev Kaul, will carry out identification as well as verification simultaneously without any human interference, Col Kaul claimed at a press conference here.
Addressing reporters here on Thursday evening , Col Kaul said ‘Chanakya Chakra’ , once implemented, will be a National-International Interface based on Dynamic Identification System, called DID.
Inspired by the ‘Palm Vein Recognition Authentication Technology’ developed by Fujitsu, Japan more than a decade ago and in ‘Direct Server Authentication and Verification’ mode, this innovative system of identification has its working based on an individual’s pattern of veins established before birth.
Col Kaul said that It was introduced in India in 2008 but is not being used extensively except for marking attendance in a limited mode.
"As no two individuals in the world share a palm vein pattern, even the identical twins differ, the use of this technology to create an interface is the most credible method of securing an individual’s identity. It is unlike other static identifications like UID and has a different dynamism in its system, that is most needed at national level now with all round development and growth. The implementation of the same would take nearly two to three years in a country like India." Said Col Kaul.
In order to make the whole process crystal clear , Col Kaul has documented the detailed study and the necessary explanation of the mega project in an especially written trilogy of ‘Creative India Books.’
Throwing light on the increasing number of threats to the identity of an individual and everyday incidents like Vyapam Scam, MGNREGA Scam, RTE Scam, Delhi EWS Scam and other Anti-social activities like Hacking and Siphoning of Bank Money to Nigeria and Human Trafficking, etc, Col Kaul said,'there is a need to introduce such a project which cannot be challenged. ‘Chanakya Charka’, with a technology fully suitable for the same, is a sure way to secure the identity of nations and the sooner it is implemented, the better it would be for our nation as well as the world as a whole.'
Two of these books have already been released under the titles- “Creative Politics, Creative India, Creative Youth in a Global Perspective” and “How To Make India Secure Again Technologically' and the third book is yet to be released. UNI

New Delhi, Feb 13: The Supreme Court on Tuesday said the idea behind the Aadhaar card scheme could be the reason that people should have one ID card.
The apex court was hearing the pleas challenging the constitutional validity of the Aadhaar scheme.
A five-judge constitution bench headed by Chief Justice Dipak Misra, and comprising A K Sikri, A M Khanwilkar, D Y Chandrachud, Ashok Bhushan, was hearing the submission in the matter of Aadhaar Card.

It does not mean that the state will make a statute having unconstitutional provisions to deal with law abiding citizens. It was submitted before the court that what the court will decide relate to 'me, my children, my grand children and their unborn children.'
It was submitted that after referring to various provisions of the Aadhaar Act that architecture of the law was “unconstitutional” and submitted that the nine-judge bench’s privacy judgement had laid down that “the identity of a person cannot be made a public identity and the identity details cannot be centralized.
It was submitted before the court that Aadhaar law presumed a person to be criminal until he is proved innocent and our fundamental identity is that we are the citizen of India. It was further submitted before the court that the state cannot make a benefit or privilege conditional upon an individual giving up his or her other rights, including fundamental ones.
It was submitted that Aadhaar scheme infringed dignity, freedom and equality and turns a person into a digital entity.
